Minority Juvenile Crime And Its Prevention Countermeasures

There are 55 minorities in our country. Although they only take up 8.08% of the population, the minorities' autonomous prefecture dominates 64% of the territory. The healthy grow-up of the minorities' teenagers is the guarantee for the successiveness of enterprise of the minority groups and the better development of the Minorities, as well as the building of a socialist harmonious society in our country. The existence of the serious minority juvenile delinquency is not only a problem for the social security, but also an essential issue which matters the grow-up and the quality of the whole generations and the construction of a socialist harmonious society. Through the studying on the current situation of the minority juvenile delinquency, we are seeking the measures to prevent the minority juvenile delinquency which is important and practical to achieve the aim of building the socialist harmonious society and ensure the lasting stability of our country.At the very beginning of the article, a definition for the minority juvenile delinquency has been drawn. Minority juvenile delinquency is a combined concept, which is one kind of the juvenile delinquency, as well as one special situation of minority crime. Minority teenagers are the minority of the minority. Thus, their criminal behavior not only consists of the special nature of the minority crime in general sense, but also includes the characteristics of the juvenile delinquency which distinguish it from the crime committed by adults. These two aspects mixed with each other, which definitely makes the minority juvenile delinquency more and more complicated. This article analyses the factors causing the minority juvenile delinquency from several different perspectives, hoping to find appropriate and effective preventing measures.In the first part, after defining the concept of minority juvenile delinquency, it reviews characteristics of the crimes committed by them. From the aspect of their occupation, the unemployed and migratory workers take up the majority of the subject of crime. And the characteristics of their criminal mind can be reflected upon different aspects ranging from pursuing for richness, crowd psychology to anti-society. The criminal objects essentially include theft, affray, creating troubles, rape and intended injury, and mainly, property infringement. While the carrying-out of these crimes denotes the characteristics of being paroxysmal, continuous, smart, single motive, absurd and revengeful intention, cruelty, and with special minority' s feature.The second part analyses the cause of the minority juvenile delinquency, both from subjective and objective point of view. The subjective cause is that the immaturity of their philosophy, values, mind and their sensitive emotion, urging easily and lower capability of distinction make them easy to go for a wrong way, finally leading to crime. And considering the objective cause, first of all in the legal prospect, the teenagers have naturally got used to settling the conflicts through their minority's custom in the process of grow-up, while with regard to the current situation the custom is inconsistent with the duly effective law; therefore, for most time the teenagers can not tell apart the crime from innocent. Besides, it also explains the negative impact on minority teenagers from the aspects of receiving ill education from society, family and school.The third part analyses the preventive measures based on the factors causing the crimes. Firstly, take advantage of the positive aspect of the minorities' custom and religion to limit crime. Secondly, focus more on the education. Reinforce the family education, improve the quality of the marriage and parents, standardize the behavior of the parents ameliorate the family relationship, and finally make sure the parents communicate more with the kids. Parents should study relevant laws by heart and learn to educate kid in a correct way and get the knowledge of how to prevent their kids from committing crimes. At the same time, schools need to put the morality education at first place, enhance morality education, develop necessary legal education and initiate a good job on helping students lagging behind and occasionally committed wrongs. If the situation allows, the education department need to spend more on the education and provide more opportunity for being admitted. Thirdly, strengthen the management of social education, purify the social environment, strengthen the management on the education for disengaged teenagers and ensure their legitimate rights. Moreover in some circumstances, establish mental counseling and reversing center and helping the teenagers from mental difficulties and finally grow up healthily. Fourthly, strengthen the construction of legal system and crack down crimes strictly. In the field of legal system construction, we should focus not only on the construction of legal systems concerning teenagers and minorities, but also intermediate the conflict between the minorities' customs and codified law, which is beneficial for the teenagers to set up a corrective legal view and to be incorporated into the legal society, so as to better prevent the crime.Minority teenagers are the hope and future of the ethnic minority areas. Studying on the problems of the minorities' juvenile delinquency and its prevention measures can provide basis for the making of the policies of minorities' crime and reference for the formation and development of the minority legal system.
