Research On Protection Of Agricultural Intellectual Property Rights

Agricultural intellectual property is a weapon of legal means to protect the agricultural science and technology achievements and market competition. In 2009 February, "Hunan Provincial Intellectual Property Strategy Implementation Program" introduced, proposed to pay attention to the intellectual property of agriculture, developing modern agriculture with regional characteristics.The first chapter is introduction. The current situation background, purpose, significance and the domestic and foreign research clarifies the research. The second chapter mainly elaborates the concept of agricultural intellectual property, intellectual property and some related theory., expounds the homogeneity and heterogeneity of agricultural intellectual property rights and other intellectual property rights. The third chapter of Yongzhou agricultural patent, trademark, agriculture new plant varieties of three types of agricultural intellectual property creation and possession of Yongzhou agriculture were analyzed, and the intellectual property administrative departments of existing policies and measures, agricultural use of intellectual property rights is analyzed, and points out the following problems:the universities do not attach importance to the work of intellectual property rights; protection of new plant varieties and breeding methods of conflict; inventor of agricultural enterprises, there are concerns to the application for patent; agricultural businesses and innovators of intellectual property protection consciousness is weak; the government science and technology project, investment in science and technology and intellectual property output is not proportional to; some support policy implementation is not in place.
