China's Rural Land Use Right Transfer

With the building of a new socialist countryside, reformation of circulation of the use of farmland is of great importance to the whole rural economy.In the first place, this dissertation points out the significance of a research into the subject of circulation of the use of farmland, existed researching progeny, researching object and methods we use in the paper.Secondly, it reviews and analyses relative theories concerning the use of farmland advanced in woks written by Karl Marx and Friedrich Engels.Thirdly, it reviews the development history of the circulation of the use of farmland from before and after the 3rd session of 8th National People's Congress of People's Republic of China with a key point put in the latter.Fourthly, it analyses the problems of our current system, not only from the economic aspect, but also from the legal aspect Then, it introduces main viewpoint, which is "an equal, negotiated, legal, unconstraint and paid circulation". Furthermore, this dissertation expounds the feasibility and the necessity of this scheme and points out clearly what will be brought out if this scheme is carried out.In the whole, this dissertation suggests the direction and principle of reformation of circulation of the use of farmland. It holds that the final value criterion should be that whether it can better people's life and realizes people's freedom and equality or not I hope that my dissertation can do some good to deepen the research about the reformation of current system.
