Rural Collective Construction Land Transfer Mechanism And Performance Studies

Rural collective construction land (RCCL) is the important component in the rural collective land, and it plays a important role in the development of economy of our country. In the recent years, with the development of industrialization and urbanization, the demand for RCCL has been standing increased. At the same time, the phenomenon of conversion of RCCL becomes universal.In addition, the national policy and laws about RCCL is adjusted continually, but relevant institution and rules haven't been set up. Owing to the law's handicap. land property institution's faultiness and management lag, there are still a lot of private conversion behaviors of RCCL recently, which brings about a series social and economical problem, such as land using confused, transaction insecurity, and farmer's benefit aggrieved. So, it is a realistic problem that whether RCCL land can get into transfer and how to regulate collective construction land's conversion.This dissertation makes an in-depth study on RCCL after an on-the-spot investigation and a wide range of data collection. It concludes five parts mainly as follows:(1) The first part which including chapter2 is the literature review. The themes and relative concept of the research in this part has been clearly defined. The author also reviewed some related basic theories about conversion of using rights for RCCL.(2) The second part expatiate the formation and relevant laws and regulations of the RCCL's conversion. The birth of the household contract responsibility system and the restructuring and development of rural and small town enterprise is the basic reason of RCCL land's conversion. Though relevant national laws and policies is in constant adjustments, there are still significant shortcomings.(3) In the third part, the author concludes the experimental unit's experience of Wuhu. Suzhou and Shunde and gets some revelations. The success of experiment unit not only proves that RCCL can transfer or get into the market to transfer, but also gives some experiences to other areas' conversion of RCCL.(4) The fourth part is the focus of this research. By collecting research material on the spot, the author did some demonstration research mainly on the conversion of RCCL in Huzhou city, Zhejiang province. At first, the author analyzed the present situation of the conversion of RCCL in Huzhou (including the format, model and characteristic of the conversion) and the major existing problems, and then established a theory model, demonstrating the influence factors of the conversion of RCCL driving factors and obstacles, at last assessed the performance of the conversion of RCCL from the point of view of efficiency and equity.(5) The fifth part includes the research results and policy advice. Based on the foregoing research, the author put forward policy advice on how to consummate the mechanism of collective land's conversion and how to innovate RCCL institution.
