The importance of food safety can not be emphasized too much. Recently, the problemof food safety causes public discontent and panic. The establishing, perfecting of food safetylegal system is a legal problem which is quite important and urgent. The number of relevantlegislation has been much more intense, but the system performance or say, the legaleffectiveness is seriously insufficient. A main problem is that the lack and inefficient ofrelated operation mechanism, and that the lack of consciousness of mechanism, objectives,framework, technology and effect. Accordingly, the research of this paper is: The establishing,perfecting of relevant industry autonomy system. Mainly includes the autonomy,independence, freedom, self regulation of food businessman. The research methods are: caseanalysis, comparative analysis, logical analysis.The significance of this research: Food safety has a great influence on the economicdevelopment and social stability and also on the health and life of ordinary people. Foodsafety problems may bring government crisis and social risks which has caused the highattention by the learners in both academics and practice as well. This paper, with the help ofthe case of Zhang sued Dairy Association of China (DAC), does a preliminary study on thesignificance, status, function and operation mechanism of associational autonomy in foodsafety legal system by means of analysis report in order to contribute to the improvement offood safety legal system in China.The paper is divided into three parts. they are the preface, the text and the conclusion.The introduction, this part describes the status of China’s food safety briefly and explainsthe topics of theoretical and practical value.The text, this part is the main part of the paper, including four parts:The first part is the introduction of the subject matter of the case, the details of the case,the court trial, the case’s controversy focus and the questions hidden by the case, namely, tobring up the question of legal system and mechanism from phenomenon and empirical facts.The second part is the relevant comparative analysis. This part introduces the status,function and operation mechanism of associational autonomy system in market economycountries, such as America, France and Japan, and also including study on the status of foodindustry autonomy, introduction of legislation relevant to food industry autonomy, the roleindustry association plays, and the experience and logic it reveals. The third part analyses the food industry autonomy. Through the analysis of currentsituation the author concludes that there is no substantive autonomy in food industry in China,and analyses the reasons. It includes weak association, imperfect law system, lacking ofautonomy rights, positioning deviation, and insufficient self instruction, etc. And the authoranalyses the ideology, institution and arrangement of Totalism.In the fourth part, the author forwards his own views on perfecting the food safety legalsystem in China and points out the direction of reform of the food safety legal system.Including formulate rules for the implementation of the food industry autonomy, reconstructthe relation between government and association, expand the food industry autonomy,cultivate association from farm to table, improve the food association credibility and improvethe restriction mechanism of industry autonomy.The conclusion, the author summarizes the main contents of the article in this part.
