On The Economical Law Protection Of SMEs

The economy of small and medium enterprises (SMEs) is the key point of economic growth. During the 30 years of reform and opening up, SMEs had made tremendous contributions to enhance the GDP and solve the employment problem in China. However, under the impact of the planned economic system, the concept of regarding the public and despising the private is still ingrained. Legal protections for SMEs not pay enough attention which made SMEs survived gingerly. Since the financial crisis, changes in the way of economic development once again become the focus. Because of the constraint of financial, material and manpower, SMEs lack the capacity in crises. Thus, technological innovation has become the only way to enhance competitiveness of SMEs. As a national regulation law, economic law should assume an important responsibility to protect the technological innovation of SMEs and build a sound legal environment. This paper based on previous studies, the economic law as the starting point, through the analysis of technological innovation of SMEs, comparing the relevant legislation of the foreign, to identify our shortcomings and make improvement.In this paper,"On the Safeguard of Economic Law for Technological Innovation in SMEs"in the title, the body has five parts.Part I - Introduction. This part gives a brief description of some basic issues. Of topics including the purpose and significance, relevant literature review, research ideas and methods.Part II - The theoretical basis of technological innovation of SMEs. This part firstly studies the current situation of SMEs in China. From the definition of small and medium enterprises in order to identify the specific standards of the provisions of SMEs; on the history of the development of SMEs in China to sort out analysis, which leads to the necessary technological innovation of SMEs. Then focus on the needs of SME technological innovation system, the system is divided into the relationship between innovation and technological innovation, and the Law to Technology Innovation Foundation (from government intervention, economic justice, and sustainable development theory involved.) Through this part of the overview, the main purpose is to find out the circumstances surrounding the theory of technological innovation for SMEs, the following analysis provides a solid theoretical basis.Part III - The supply system of the economic law of technological innovation. This is a key part. The fifth part of the proposal is also based on this. This part of the economic law as the starting point, from the Law of the specific system (macro-control and market regulation), round, multi-perspective of technological innovation of SMEs in the current security system, and the lack of and the reasons were analyzed.Part IV - Experience of developed countries on technological innovation. This part selects United States and Japan to analyze how they protect the small and medium enterprises looking for technological innovation, and summed up the two countries have in common, to guide our legislative practice.Part V - Improvement of economic law of SMEs'technology innovation System. On the basis of our current lack of economic legislation of SMEs, this part advance the corresponding perfect proposal which including the macro-regulation and market regulation.
