| It has always been regarded as one of the most significant and sensible studies to observe and investigate the relationship between public opinion and justice. Determined to focus on this issue, the concept and characteristics of public opinion was primarily introduced, followed by the detailed analysis of the relationship between public opinion and justice specified for different eras of China. Individual cases were explored through which below facts were eventually clarified that a double-edged-sword effect was generated by public opinion against the justice and that it's requested that a certain distance between public opinion and justice should be kept to ensure the judicial independence. Comparisons with experienced western countries were carried out to conclude that for a positive interaction between public opinion and justice it would be demanded some measures being carried out in different aspects including principle of adjudication, judicial basis, the concept of adjudication & etc.The thesis contained structurally the Introduction, the Main Body and the Conclusion.The concept of "Public Opinion" was arisen with some issues which are currently under wide discussion in the society. The origins and development of this concept "Public Opinion" in both Chinese and western society was also briefly introduced in the subsequent text.The main body was divided to three chaptersChapter one:In the first section the concept and definition of public opinion was introduced, with the different sorts of the public opinion classified, only two of the categories were further focused on. All the main characteristics were listed in the second section, including the Characteristics of the Subject of Public Opinion, the Characteristics of the Developing of Public Opinion, the Characteristics of the Content of the Public Opinion, the Characteristics of the Form of the Public Opinion, the Characteristics of the Effect of the Public Opinion, the Characteristics of the Quantity of the Public Opinion, the Characteristics of the Expression of the Public Opinion, etc.Chapter two:the relationship between public opinion and justice was analyzed in depth based on Chapter one. In the first section, investigation was made based on the historical aspect, started from ancient time of China and ended at the new era of 21st century. In the second section, information was given based on the individual cases to show that the Effective Supervision the Public Opinion holds to the Justice, the influence the public opinion could generate to the Judicial Independence and the reason why a balanced distance should be kept between both.Chapter three:focused on the method of realizing the positive interaction of public opinion and justice, this chapter also contained two sections. In the first section the categories of experienced western countries were given, the Jury System, the internal support from Legal Professional Community. In the second section the analysis was made based on various aspects of principle of adjudication, judicial basis, and the concept of adjudication.Conclusion:the belief was held that the positive interaction between public opinion and justice could be eventually achieved through various measures. Examples would be then to develop and improve People's Assessor System. |
