Looking for high quality drinking water has became an important pursuit of social life at present, taking charge of the safety of drinking water has became a rigid demanded for ensuring residents health. The safety of drinking water should contain three aspects:qualified water quality; water quantity guaranteed and has the capability of dealing with sudden event of the safety management of emergency, with the result that drinking water safety regulation refers to the relevant institutions according to relevant laws carry out supervision and management of the process about quality of drinking water; the yield of water; comfort level and assurance rate. From the practical point of view, the whole process of regulation from water source to the tap requires to meet the water quality is qualified in the system of each step. At the same time, it must have the corresponding ability to resist risks; it can conduct joint supervision and make corresponding assessment report for water quality. Thus, it can reflect the security situation of drinking water accurately and timely.In recent years, water pollution incidents as well as the southwest drought exposes a lot of realistic problems in the drinking water in China. At the present stage, the drinking water safety’s laws and regulations and departmental rules of contents are scattered; legal hierarchies are different; overlap and missing coexist；systematic, operational, coordination are not strong in drinking water safety related laws, which is far not meet the requirement of drinking water safety regulation. From the logic of the law system, rigor requirement point of view, the drinking water safety lacks of specific legislation, which leads to the related provisions of administrative laws and regulations and department rules can not get authoritative corresponding support.It makes that legal norm can not connect well between different effectiveness ranks; consequently, the drinking water safety supervision law system hierarchy is not clear, the structure is not complete. Especially at present, the public’s requirements for the safety of drinking water are increasing day by day, and the drinking water quality affects directly human health and the goal of comprehensive well-off construction, therefore, in order to ensure the safety of drinking water, it must be draw up special legislation of drinking water safety. Currently, the experience of abroad on drinking water safety supervision is relative mature; it has been proved to be effective and feasible so far, and the number of system have its rationality and significance, too. By studying the drinking water safety supervision system of the United States, Britain and Japan, which can find foreign legislation in drinking water safety regulation is more perfect than China, unified water quality standard; clear supervision organization’s powers; perfect emergency disposal system;timely and effective supervise in water source.Considering china’s social and economic situation, the improvement of drinking water law system should be the most essential measure. Firstly, as the fundamental of laws, Safe Drinking Water Act must be mending, and the relative regulation should be set up, such as correspond institution rules, water quality standard and subsidiaries’ framework. Secondly, it is necessary to build up an effective supervision institution sort of drinking water quality and strengthen its legal power. Lastly, as the supplements to basic law system, the authorities should complete drinking water safety emergency responding system, public the result of water quality testing and stimulate citizens involve supervision. As a conclusion, china’s continuous development needs a full-order potable water system and a completed safe drinking water system requires not only the improvement of legislation, but also the effective supervision framework. |
