The right to housing is a basic right of our citizens, and the housing security system is an important part of China’s social security system. In recent years, China has developed real estate economy rapidly, and housing conditions of urban residents has been greatly improved. Meanwhile, the housing security system of our country also has established and developed. Through the affordable housing and the low-rent housing, the government solves the social conflicts due to soaring housing prices, so that part of the urban residents in the housing problem can be solved. But in our country, there is such a crowd that neither has enough money to buy an affordable house, or get the line of poverty to rent low-rent house. For example, the low and middle income families, the new graduated employment, the migrant workers, and so on. This crowd accounts for a large proportion of urban residents. If their housing problems are not properly addressed, very serious social problems will be lead to. So the concept of public rental housing gradually entered people’s attention, and the establishment of the system has also been widespread concern in the society. In2010, the Ministry of housing and urban-rural development and other7ministries jointly issued the "Guiding opinions on accelerating the development of public rental housing", and in2012they promulgated "the Provision for of the public rental housing", reflecting the state’s determination to solve the housing problems of low and middle income families and individuals. However, due to the late start of China’s public rental housing system, the legal system is not perfect, especially in the legal aspects of the relevant legislation of the housing security system. So, there are many problems in China’s public rental housing system to be solved.In recent years, many scholars put forward their own opinion on the establishment and development of public rental housing system, and published academic papers and theoretical articles. They discussed the objectives of public rental housing, the objects of protection, the range of defining, and pointed out that the public rental housing system and the legal system in China is not complete and lack of effectiveness. It should be said quite positive meaning to improve and perfect the system of public rental housing. Drawing on the theoretical results of domestic scholars and combining with my own research, this article started from the basic concepts and theories of public rental housing, and analyzed the status and role of public rental housing in China’s housing security system. Through researching the Jurisprudence, Constitutional and the Social Security basis of public rental housing system, summarized the theoretical basis of it. Through researching the characteristics and development process of foreign and domestic public rental housing system, summarized the experience and inadequate. I thought of the process of the legal system construction of public rental housing problems, and recommend to improve the system of public rental housing.
