Research On The Violent Resistance To The Urban Administrative And Law Enforcement

Since China began a pilot of the urban administration integrated law enforcement in 1997, fourteen years has gone through and the integrated law enforcement has been forwarded to the whole country from the pilot at those years. The urban administration integrated law enforcement has become the main force in the urban administration, has made undeniable contributions to the maintenance of urban city environment, the resolution to the contradictions in social life and the guarantee of social and public interests, and has initially solved the long-standing problems in the urban administration such as cross functions, duplicate law enforcement, law enforcement harassment and management absence. However, the urban administrative and law enforcement has been constantly encountered with the violent resistance. In recent years, the violent resistance to the law enforcement has been rising in the number and intensity and has had a relatively great negative effect in the society, which becomes a major obstacle to the smooth operation of the urban administrative and law enforcement. The failure to solve the violent resistance to the law enforcement properly will bring out a number of problems, not only damaging the image of the government, hindering the normal work of law enforcement officers, but also seriously affecting the social harmony and distorting people's legal values. The approaches to solve the problems should be actively sought.This paper, based on the status quo of the urban management in China and the analysis of the concept, characteristics and hazards of the violent resistance to the law enforcement, makes detailed analysis of the violent resistance in the urban administrative and law enforcement, and elaborates in detail the reasons for the violent resistance. According to actual work experience and in combination with the Constitutional and Administrative Law, relevant laws and regulations of the urban management, the basic theories and methods in the administrative management and other disciplines, this paper puts forward the corresponding measures for the solution of the violent resistance.This paper is composed of four parts: the first part is the introduction, introducing topic selection background, research status quo and significance, research ideas, innovation and deficiency.The second part describes the concept, scope, the evolution and a brief comment on the urban integrate administrative and law enforcement.The third part describes the violent resistance in the urban administrative and law enforcement. This part analyzes the concept, characteristics and hazards of violent resistance. The fourth part analyzes the causes of the violent resistance thereto, making analysis mainly from urban management system, the government, police protection, law enforcement agencies and law enforcement officers.The fifth part puts forward the suggestions for the solution of the violent resistance from macro, meso and micro aspects.It is hoped that this paper can have a practical guidance meaning to the urban administration integrated law enforcement so as to improve management practices, reduce the violent resistance thereto, have the urban administration integrated law enforcement standardized and governed by law and make our cities more harmonious.
