With the development of law-based management of state affairs, Chinese people's subject consciousness is being stronger, and the issue of justice in all sectors of the society has received extensive attention. Fairness in education is the extension of social justice to the educational sector. It is an important aspect of social justice, and has been strongly called for by both academic community and the public. In the process of transformation in higher education in China from elite education to mass instruction, public attention has moved from the admission opportunity to the process and outcome of education. The problems with fairness in higher education in China have multiple roots, including politics, economy, and culture. Invisible inequality can be found many areas in education system such as subject selection,curriculum arrangement, textbook construction, classroom instruction, and so on. In legislation, the undersystemization of safeguard provisions for equal right for education, limited amount of the provisions, and too much of declaration like provision making have seriously affected the realization of the citizens'equal right to education. The problems in the administrative enforcement of equal right to education are detrimental to the protection of this right. The lack of understanding of judicial guarantee of equal right to education allows the infringement of this right to happen without effective relief, further hampering the realization of this right.At present, although "gender" is mentioned in the studies of equal right to education in the field of China's higher education, the research on equal right to education from the perspective of gender is lacking. The current study investigated the situation of equal right to education in the field of China's higher education from the perspective of social gender.This thesis is divided into three parts. The first part presents the theory of social gender and equal right to education. First introduced is gender theory, including the connotation of gender and the function of gender perspective analysis method. What follows is the introduction of equal right to education, including the definition of equal right to education, and the connotation and features of equal right to education in the field of higher education. The gender theory and the theory of equal right to education are the basis and premise of subsequent factor analysis and proposals of countermeasures. In the second part, based on the data presented, gender related inequality in higher education in China is described regarding unequal opportunity for access to education, and inequality in the process and outcome of education, with the analysis of factors in politics, economy, culture, and institutionalization. In part three, countermeasures are proposed regarding building the culture atmosphere for gender equality and harmony, introducing gender education to higher education, carrying out differentiate education based on gender, establishing women's colleges of new types, and improving the employment guidance for female college graduates. Finally, it is also discussed how to promote fairness in education by providing comprehensive guarantee of equal right to education for females in terms of legislation, jurisdiction, and administration.
