The Study On The Relationship Between Evolution Of Environmental Ethics And The Development Of Environmental Law

Based on theoretical research, this article studies the evolution of ecological ethics and the development of the environment law by the methods of combination of historical materialism, comparative analysis, value analysis and multi-analysis, and explores the relationship between the two aspects. Firstly, from the metaphysical view, this article elaborates the inner relationship between morality and law and comparatively analyzes morality, ethnics and law from a homological value. Secondly, by combining the vertically historical evolution with the lateral comparison between western and eastern viewpoints, the article aims at re-finding the evolving and developing interactions between the ecological ethics and the environment law. Eventually it comes to the conclusion that environmental ethics has become a parcel component of epistemology of environment law. The environment law theory, with a view towards adjusting the relations between human and natural environment, basically has come to the stage of ripeness. The contemporary environment law of the ecological legal standard-based theory should be established.Under the current circumstance of contending against choosing what kind of ideology, the innovation of this article lies in putting forward a creative ecological legal standard ideology" that new type of ecological ethics should be established to adapt the modern environmental legislation. It also provides rational suggestions, in contents and transformation of the structures of the environment law of China, that confirm the constitutional position of sustainable development in content and adjust the current Environmental Protection Law as a basic law into "Model Environmental Justice Act".Ethics, as a particular mode of human’s life, infiltrates every domain of human activities including law, thus making the environment law exist impossibly without support of ecological ethics. This article is nothing else than enhancing the penetration strength of the value orientation of ecological ethics, establishing general principles of environmental legislation as well as furnishing theoretical basis and intellectual support of a new type of environment law appropriate to the good and steady economic growth.
