The Study On Legal Problems Of The Citizen Network Political Participation In China

Network with its unique IT has quickly grown to the expressing masses and the efficient reflecting platform of the citizen wishes.Therefore, driven by the public interests, public affairs and public wills, a new way of citizen political participation such as the network political commentators, network monitoring, network information, network evaluation and network interaction has coming to the existence. And it opened up an open, interactive, real-time network of political space which is the new political participation in the carrier, deepened the form and content of citizen political participation, at the same time it make the timely communication between the stakeholders and the subject of rights come true, promoted the further development of our country’s democratic and political construction. But due to the limitations of cyberspace and the immaturity of the citizen participation environment, the network of political participation in our country has negative fact such as the participation of non-rational, non-normative, disorder and other defects. So this paper attempts to study on multi-angle resolution affect the network’s political participation in China from the level of legal and political, social and other resistance factors, and to explore better ways to promote the development of political participation healthy, stability and orderly in China.The first part introduces the research background, significance, contents, the research focus, domestic and foreign research status and the research methods. The second part from the beginning of the concept of network political participation, first analyzes the characteristics of network political participation and then from the two levels of meaning in rational argument and the rule of law describes its theoretical basis-public participation theory, The third part introduces the rise and development status of network political participation in China, and make a further summary for its functions;the fourth part analysis in detail of the main problems of network political participation present in China from the subject,regulatory, legal, social and other multi-angle:firstly, participants in the non-normative and disordered;secondly the institutionalized channels for participation supply by government is inadequate,the construction of the government websites is unreasonable,the oversight of network information is in poor, etc.Thirdly,the legal environment of the network participation is not perfect.Finally, the existence of the digital and the weak of social participation culture is indeed appear.For the current existence of many problems, the fifth part of the article give a series of measures and suggestions in improvement of the network legal system,e-government and responsive government construction, and including bridging the digital divide,foster a culture of citizen political participation,form the social environment to better improve the network political participation. In a word, I hope promote the sound development of the network political participation in China.
