On The State Obligation To The Rescue Of Street Children

The problem of street children is a universal social phenomenon which exists both athome and abroad. Far away from the love of parents and family, street children aresubjected to a variety of social harm, even the most basic of life is difficult to beguaranteed. Street children are the most vulnerable group, they need highly concernedfrom state, social and personal.The purpose to emphasize state bears the rescue obligations to street children is tomake sure that the state can protect the fundamental rights of street children effectively,and make the rescue of street children completely and effectively. The reason that streetchildren wandering are different, it is performanced different types of street children, thefundamental rights which infringed are complex and diverse. Establishing the theoreticalbasis of state’s obligations to rescue the street children, and adapt to the needs of thefunction of fundamental rights, to meet the requirements of state guardianship system, andline with state responsibility to protect the welfare of children. However, there are someproblems in rescuing of street children, such as the legislation is absent, the protection isinadequate and the relief is poor. To face the plight of street children’s fundamental rightsdamaged, as the main bearer of security obligations, state should provide specific measuresin legislative, administrative and judicial, to fulfill the obligations on rescuing of streetchildren, and thus, the fundamental rights of street children are effectively protected.
