Since then, national emergency management system (NEMS) has launched. Emergency Logistics System (ELS) plays an important role in reducing casualties and economic losses significantly during catastrophic event, especially when assisted by military force. A considerable numbers of defects in domestic ELS, however, should be noticed with respect to the safeguard measures during supplying process and the lack of related legal documentation, such as standardization, establishment of compensatory mechanism, legal supervision mechanism, etc. Legal documentation is the foundation for civil right. For the safety of people’s life and property, for the in-time delivery of emergency supply, for the minimization of catastrophic damage, it is urgent to launch and optimize the ELS-related legal provision.Herein, comparisons between the development of domestic and foreign ELS in term of the topic of interest will be first described, summarized and analyzed. Moreover, through specifically description about the United States and Japanese emergency logistics and legal protection mechanisms, several achievements our country should learn from these two well-developed systems will be pointed out, including a description of the legal system, standardization, legislation and compensation mechanisms. Insurance mechanism, including the detailed report of current status of emergency logistics and legal protection mechanisms, of ELS in China will be then introduced, through the analysis of the problems of Emergency Logistics legal system in China, such as the low level of national standardization legislation, the non-sound compensation mechanism, etc. At last, several amendments for the issues of interest will be suggested, such as improving the construction of the compensation mechanism in China, accelerating the formulation of emergency logistics standardization and optimizing legal supervision mechanisms:Finally, the establishment of emergency logistics and legal protection mechanisms, development and optimization of legal protection mechanisms of ELS have become China’s a very critical project to ensure social security, safeguarding national stability, promote social harmony.
