Research On Trade Unions’ Protection Of Rights Of Peasant-workers In Shandong Province

The peasant-workers gradually become a big and no neglecting social body with the speeding of the industrialization and urbanization of china after the reforming and opening. They have made great contributions for the economy of our country, especially for the economy of cities. But the rank and rights of them are not equal to the city workers. For the time being, solving the problems of the peasant-workers is the key for the further developing of the urbanization and realizing the sustainable development of the society. So, with the increasing of the quantity of the peasant-workers, how to protect the rights and interests of peasant-workers is an important subject for the Trade Unions.There are five parts in this article. The first one is Prolegomenon, which introduces the purpose, the present situation and the method and thought for the researching of the protection of the rights and interests of peasant-workers. The second part is mainly introducing the relevant theories about the protection of the rights and interests include theory of the peasant-workers, theory of the protection of rights and Interests, theories of the Trade Unions responsibilities. And the third one is researching the present situation of the peasant-workers. We have analyzed the data relating to peasant-workers in2010to analyze the present situation. Currently the scale of peasant-works expanding, the educational level is improving, but the whole level is still low. Most of them work in the secondary industry, and the ratio of working in the third industry is increasing. In addition, we briefly introduced practices and countermeasures for the Trade Union in Shandong province. And the fourth one the problems and causes of the right protection of the peasant-workers in the Trade Unions of Shandong province are introduced. The main problems include the salary is level is low, the social security for the peaseat-works are commonly lacked, the situation of the salary defaulting is not eliminating, about60%of them have not the contracts, and Trade Unions does not do enough work to protect the rights of them.The reasons leading to these problems mainly include the urban-rural dual structure, unsound law for the protection of the rights of the peasant-workers, the lacking of the government management, the lack of ability of rights protection, and inadequate work to protect the rights of workers. In the last part, these practices and countermeasures are concentrated in the improving the employment and the function of the Trade Unions. We suggest that the Trade Unions should deeply involved in the legislation, improve the openness of the factory affairs and protecting of rights and Interests of peasant-workers, promote the negotiation for salary, Strengthen the training for the peasant-workers and the training for cadre members in Trade union, and help the peasant-works with difficulties.In this work, linking up with the author’s practical work and the relevant theories, the protection of rights and Interests of peasant-workers has been analyzed. And the problems in the protection of rights and Interests of peasant-workers have been researched from the standpoint of the Trade Unions. The countermeasures and suggestions for the protection of rights and Interests have been given form the aspects of the necessity, ways and methods. And trying the best to theoretically analyze the problems and give the scientific and practical suggestions.The innovations in this article are as follows:Basing on lots of data, we analysis and found the main problems on the protection the rights and interests of peasant-workers, conclude the works for the protection the rights and interests of peasant-workers made by Trade union of Shandong province. And some measures for the protection the rights and interests of peasant-workers have been advised according to the relevant theories, including deeply involving in the legislation, promoting the negotiation for salary and so on.
