Research On Government Information Disclosure System Of Public Emergency

The Emergency Response Law which comes into force on November1,2007and Regulation on the Government Information Disclosure which comes into force on May1,2008are the significant law and regulation on government information disclosure of public emergency, which not only provide legal guarantee on information disclosure of public emergency, but also promote the development of practice. However, the government information disclosure system of public emergency of China is not perfect; there are still many inadequacies, as much need to be improved in practice. Therefore, there is still a long way to go in government information disclosure of public emergency. It has great theoretical and practical significance in the study of government information disclosure system of public emergency.The paper analyzes the problems of government information disclosure exposed from the "4·13" event, finds out the inadequacies in China’s current government information disclosure of public emergency. On this basis, the paper put forwards the countermeasures and suggestions to improve the government information disclosure system of public emergency on learning from the advanced experience in this aspects of United States and Japan. The paper includes the contents of the following four parts:The first part expounds the government information disclosure of public emergency in theory, analyzes the concepts and features of public emergency and government information disclosure, as the legal basis and significance of government information disclosure. The second part chiefly introduces the legislative experience and management system of government information disclosure of public emergency of United States and Japan, sums up the reference significance to China. The third part chiefly analyzes the status quo of government information disclosure system of public emergency in China, and the problems exposed from "4·13" event and its causes. The fourth part put forwards the countermeasures and suggestions to improve the government information disclosure system of public emergency in China from five aspects.
