Volunteer Service Contract Research

In the nineteenth century， voluntary service originated somereligious charity services in western religious country， and thendeveloped into free services for others that based on moral and socialresponsibility and so on.In Chinese mainland， voluntary servicedeveloped with Reform and opening up.From1987year， the firstvoluntary service hotline phone appeared in Guangzhou，to1994year，the national“China youth volunteer association”was established，andthen to2010year，during the world expo，a large number of volunteerjoined in，voluntary service developed well in China.So many of the people involved，such a wide range of voluntaryservice areas，would draw peoples attention undoubtedly.The questionof how to guarantee the rights of the volunteers，especially Personalrights；what kind of legal relationship between volunteers and theperson or institution who acceptting the services；organizated voluntaryservice， what kind of legal relationship between organizers andvolunteers；whether required quality of voluntary service or not；how toensure the quality of voluntary service and so on，then were putforward.Facing these problems，some researchers researched from publicmanagement aspects，tried to put forward a solution；some scholarsresearched from the angle of sociology analysis， and also somescholars researched from different points of view of the law，no matterwhat way to research， they all put forward some constructivesuggestions and advice.The article attempts to research voluntary service using themethods of Law sociology from the point of view of the contract law.Inchapter one，the paper expatiates the background and significance； in chapter twe，focuses on some important concepts of the voluntaryservice，the concepts is the subjects and object of voluntary servicecontract in chapter four；in chapter three， mainly introduces thevoluntary service legislation situation in different legal system, foundproblems, put forward appeal；in chapter four，analysis of voluntaryservice contract and forms whole voluntary service contract.The author also hopes this article will be a processing mode，providing some theoretical and practical basis for promoting the furtherdevelopment of the voluntary service.
