Legal Mechanisms For The Initial Allocation Of Emission Right

Emissions trading as an important means of environmental management, has been widely applied to practice.Parts of the country, although the relevant provisions have been introduced to regulate the emissions trading but there are many unsatisfactory, the reason is that there are a lot of problems when it comes to the initial allocation of emission rights. The initial allocation of emission rights is the basis for emissions trading, which is properly related to the emissions trading can be fair and orderly. As we all know, the indicators and methods of initial allocation of emission rights which are not the same in different parts, it is these differences lead to a series unfair prblems of emissions trading, causing a very serious negative impact on China’s development and environmental protection. In the context of the current domestic emissions trading issues, this article is divided into4sections to study the related issues of the initial allocation of emissions starting with the initial allocation of emission rights,looking forward to contributing to China’s emissions trading system.The preamble describes the significance of the topic and the initial emission rights allocation system status quo at home and abroad mading bedding for the commencement of the articlePart one introduces the development of emission rights and related theories. Firstly it gives an introduction of the theoretical basis of the emission rights intensively on the whole,and then formulates the ethical value and system value of the emission rights.Part two defines the nature of the emission rights. It not only defines the nature of the emission rights based on the environmental capacity.but also making it clearly by comparing with other rights.Part three is mainly about the construction of initial distribution of emission,which analyzes the main problem of our country and then introduces the method for determining the relative factors of initial distribution of emission,at the end,comes up with the way of initial distribution. Chapter four, in order to set a rational utility method of initial distribution of emission,I analyze several principles of emission right. Besides,I point out the exisiting legal problems tally with the actual situation of our country and propose specific thoughts for legal system to ensure the method of initial distribution of emission right rationally.
