The Allocation Of Social Resources In Community

Along with the8thamendment of the Criminal Law and the newCriminal Procedure Law had been passed in2011and2012one afteranather, Community Correction was ranked one legal systerm, whichshowed the party and the government’s great attention and thepeople’s prevenance to the community correction. But the CommunityCorrection in our country has been in low level of “correct in thecommunity”, the work don’t make full use of all kinds of socialresources. This situation not only against the original purpose ofthe work, but also can’t achieve the ininal goals.Except for the introduction and conclusion, this paper is beendivided into four parts.Part Two takes the introduction of basic concept as a start,interpreting the connotation of “Community”、“CommunityCorrection” and “Social Recources”.And then,analyzed thetheoretical basis of taking using of social recources in CommunityCorrection(Tripartite Failure Theroy and Governance Theory).In Part Three, It reviews the process of development in the past10years; analyzes the the advantages and disadvantages of twotypical model: Beijing Model(the Govement-leading Modle) andShanghai Model (the Market-oriented public service) and points outthe latter is the future development derection of the work;Meanwhile,take Nantong as the object of empirical study, analyzessome practices and the problems in community correction work of acommon2-line city. Through the research of the two topic models andthe example, analyzes the restrictive factors of the using of socialrecources in Community Correction, lists10reasons in ideals、departments and systerms.In Part Four, the author observes the western countries’ssuccessful experience of using social recources in Community Correction by comparative perspective. And then, the author summedup the enlightenment to our country’s community work. The authoralso puts forward the choose of development path that based on ourcountry’s economic、social and cultural different from westerncountries.The Part Five in the focus of the paper. The author put forwardthe suggustion of take better use of social recources in CommunityCorrection based on previous study:the first is to establish thelegal system which good for Community Correction; the secord isstraighten out the relationship between government with market andgovernment with society. The third is the third-sector should playa supporting role; the fourth is to promote the development ofvoluntary community. The author put forward specific work mechanismto the above four part.
