Research On China’s Administrative Supervision System Of The Police Inspector System

Administrative supervision is an important part of state administrative management, and it’s also the important form of administrative internal supervision. As an administrative department which is different from the general administrative departments, Public Security Department has both criminal jurisdiction and administrative enforcement. So it has been brought to public attention in a long time. Although this department has social supervision, legal supervision, disciplinary inspection and supervision and audit supervision, these supervisions all give priority to accountability after the events, it is difficult to get the purpose of the synchronous prevention and dynamic supervision. In view of this, police inspection system was established in1997in China with the existing administrative supervision system. Comparing other supervision system, the police inspection system more focused on the supervision before the event and at present. It’s useful that it can not only supervise the events early, even the small events, but also correct mistakes and handle with the problems quickly and accurately. Meanwhile, as a new system, it still has the gap to the requirements of the law society, and many aspects need to explore and improve. This article begins with the basic theories of administrative supervision and the police inspection. Combined with the daily work in disciplinary inspection and supervision and police inspection, this article analyzes the current problems in the system, and uses the experience of some good domestic and foreign police supervision for reference. Also, it mainly discusses about how to improve legal laws and regulations of the police inspection, and speed up the constructions of related inspection system, and to improve the quality of inspector team so that we can ensure that police inspection effectively play the important supervisory roles, such as urged supervision, security service, prevent restriction, advice coordination and so on.This paper is divided into four parts:the first part describes the concepts and functions of Chinese administrative supervision and police inspection, and clears the relations between administrative supervision and police inspection. The second part introduces the different police supervising modes in Britain, France, Australia, Hong Kong, and Macao. The third part is to analyze the problems in Chinese police inspection system. The main causes of the problems are the deficiencies in regulations of the inspective jurisdiction on the legislative layer, the site disposition is too vague, protection of the police law enforcement rights needs to be strengthened, double-leading system makes the inspective institutions not independent enough, the relation between investigation right on illegal discipline and disciplinary inspection and supervision is difficult to clarify, some supervisions are pulled away by the Division of Complaints and Appeal, the power enforcement is restricted by traditional thinking, and police inspection procedure is lack of consciousness. The fourth part is the suggestions of how to further improve the police inspection system according to the problems. This article put forwards inspective institution should play the unique precautionary function in the whole inspection system, make and carry out the "public security institution police inspection law ", speed up the legislation on the maintenance of police law enforcement rights, build a inspective vertically integrated stationed and circuit system, perfect the inspective responsibility system of" right is duty", strengthen the construction of the professional quality of the inspectors, and constantly adapt and promote the new situation of public security work.
