With the development of the world, the Internet has penetrated into every field of society.Online shopping as a new trade mode has been more and more profoundly influence our dailylife. Because of online shopping cost lower, but much more productions, and faster carriagewhich attracts many consumers. At the same time online shopping brings new problems haveplagued consumers, such as security, privacy, claims and other problems.At the legal level, our country is still doing not have a law about the online shopping toprotect consumer legal rights. Online shopping in the tort dispute mainly refers to "consumerprotection law", which implemented nearly twenty years. At present, the law significantlydifficult to solve the existing problems that needs to be fixed or issued new regulations ononline shopping. Online shopping has developed early in foreign and China’s Taiwan, whichmany successful experience is worth to draw lessons from. In this paper, base on presentsituation of online shopping, focus on elaborating protection of consumer rights in onlineshopping. This is theoretical and practical significance of the topics.The object of this paper is the protection of interests of consumers in online shopping.First, by describing the development and advantages of online shopping in China, definitelyonline shopping market to the national economy. Second, it stated the existence of violationsof the rights and interests of consumers in the form of online shopping in China, leads to theurgency and necessity to protect the interests of consumers. Then through the mechanism ofthe Comparative Study of the relevant laws of other countries and regions, combined with thereality of our country to learn from. Finally, the above problems of legal advice, the threemechanisms and two organizations.Following progress of" discovery problem--experience--to solve the problem", adoptsthe methods of case analysis to introduced the current legal system of online shopping,comparing with abroad and China’s Taiwan which related to the field of mature experience,and to explore a new protection method on online shopping in the field of protectingconsumer rights.This paper has five parts except introduction and peroration.The first part of the thesis is composed of Taobao shop sales false products case that leadto the problem of online shopping false sale, and introduces current situation of China’s online shopping. Then elaborate the necessary of protection on online shopping from consumer sellerand economy, to portray the prospects for the development of online shopping.The second parts of the thesis focus on the narrating status quo about consumer rightsprotection of online shopping. By confirming existing measures of the large online shoppingplatforms, analyses its defects in protect consumer’s rights which including right to know,right of privacy, right of security, right of fair dealing, right to claims and more other rights.The third part of the thesis introduces our country’s law about consumer rights protectionon the online shopping. Then based introduction, elaborated the existing defects of theprotection law system of online shopping.The fourth part of the thesis introduces OECD, the United States, the European Union,Japan and China’s Taiwan of the e-commerce legislation and relative regulations, as well asthe reference to China. The above-mentioned countries and regions, e-commerce startedearlier, has now established a relatively complete system of consumer protection.The fifth part is the focus of this article. Before online shopping interests of consumerslack of legal protection, to improve the legal norms and to establish and improve the onlineshopping and various mechanisms to protect the interests of consumers. Including theestablishment of shop access mechanism, unified online shopping oversight of complainthandling mechanism, the shop exit mechanism and other mechanisms.
