Research On The Protection Mechanism Of Online Shopping Consumers' Rights And Interests

This paper mainly takes hangzhou,zhejiang province as an example to discuss the construction of online shopping consumer rights and interests protection,mainly using literature research,empirical research,comparative analysis and other research methods.This study first discusses the background,theoretical and practical significance of constructing the protection mechanism of online shopping consumers' rights and interests.Second,in clearly defined relevant concepts,interpretation of the relevant theoretical basis,with hangzhou in zhejiang province as an example,introduce hangzhou nearly five years online basic information to report complaints,hangzhou build online shopping consumer rights and interests protection mechanism of practice exploration,results,focus on analysis of hangzhou in the construction of online shopping consumer rights and interests protection mechanism problems as follows:the legislative mechanism imperfect,the administrative protection mechanism is not enough and strengthening judicial protection mechanism,lack of adequate social protection mechanisms,and analyze the reasons.Finally,aiming at the above-mentioned problems,this paper compares and analyzes the experience of foreign developed countries in constructing the protection mechanism of online shopping consumers' rights and interests,seeks for the gap between China and them,and draws enlightenment.This paper creatively put forward the countermeasures of China's construction of online shopping consumer rights protection mechanism research: first,to improve the establishment of a systematic legal system,clear internal and external cooperation and responsibility jurisdiction provisions,the establishment of online shopping consumer rights protection standards of the legislative system;Second,improve the alternative dispute resolution mechanism,build online consumption credit punishment mechanism,clear professional reporting and complaint handling mechanism,improve the business ability of supervisors and law enforcement level of administrative mechanism;Third,to strengthen the out-of-court dispute settlement mechanism and group litigation system,strengthen the judicial mechanism of inter-departmental cooperation;Fourth,we should improve the social public governance mechanism and the social mechanism of assessment and evaluation mechanism.
