Study On Legal Protection Of Consumers' Rights And Interests In Online Shopping

In twenty-first century,the online shopping is increasingly popular and has become a common way for shopping.Because the paperless transaction showed a very large superiority,coupled with the characteristic of convenient and low cost,people's consumption concept and patterns is increasingly changing.Especially in our country,with 1 billion 300 million of the population,have a large scale of net citizen,Therefore,the fictitious trade will bring large economic benefits to the whole society.At the same time,the rapid development of online shopping has also derived a lot of problems,such as our country's legal of online shopping,So how to meet the law of demand with the rights and interests of consumers is very urgent.This paper describe definition of online shopping and online shopping consumer,and analyses the existing problems of China's online shopping in the consumer rights and interests protection system,discuss the problems of the information barriers and the rule of law,and detailed analysis the reason.Secondly,the foreign legal protection of the rights and interests of consumers shopping on the network and its enlightenment to China are also discussed in this paper,expounded respectively relevant legislation to the organization for economic cooperation and development,the European Union,and United States,then analysis and studied,and summarize its enlightenment on China's legal protection of the rights and interests of consumers in online shopping.Finally,based on the above analysis,I put forward some suggestions to improve legal protection of the rights and interests of consumers of online shopping in China.Specifically include:Firstly,legislative perfection.Include the following several points:set up a electronic payment method,improvement of shopping online information disclosure system,expanding the scope of application of the inversion of the burden of proof;Secondly,improve law enforcement.Include the following several points:improve the relevant measures of electronic evidence,improve the overall supervision capacity and efficiency of the regulators,specification the format contracts in online shopping;Thirdly,judicial perfection.Include the following: establish a litigation policywhich is advantageous to network shopping consumer,establish a regulatory mechanism flexibility.
