On The Status Of Community Corrections

The "community corrections" was adopted in Criminal Law through the "Criminal Law Amendment (8)"which was approved and implemented in2011. It is a milestone of the history of China’s community corrections that the practice of community corrections turned into the text of the law. In2012, the Supreme People’s Court, the Supreme People’s Procurator ate, the Ministry of Public Security and the Ministry of Justice released the Community Rectification Measures for the implementation of community corrections with more detailed provisions about community corrections.Looking back at the beginning of the community correction experiment, the Government encourages the social work to actively participate in Community Corrections, considering the commonality of social work and community corrections on the goal of promoting social reintegration of Community Corrections on basis of foreign experience. Nearly a decade, the government has been actively promoting the carrying out of community corrections, and community corrections has indeed prospered under the promotion of the government. So the research especially regional empirical research is particularly urgent and important. Nanjing, as one of the first community corrections pilot cities, in community corrections work has a accumulated relative abundance of experience, but there are some problems in the judicial practice and other specific aspects. In view of this, the paper reviews the system theory and practice mode of domestic and international community correction, and start the case Study of the Community Corrections Center in Nanjing Q District. Through the deep research and reflections of the general backgrounds, the basic mode of operation, working methods and the effectiveness and the performances, the paper dissects the salient problems and dilemma of the present community corrections such as the multi-party management, and the interweaving of the functions and the relations between community corrections unclear division of functions and relationships community corrections implementers, the low professionalization Community corrections workers and the lack of enough social basis for the implementation of Community Corrections. Then the paper puts forward the corresponding measures and suggestions so as to provide effective support to the smooth advancement of the farther community correction.
