From ancient times, land resources has been one of the mostimportant factors which related to the national prosperity andthe stability of citizen’s life.Since the foundation ofPeople Republic Of China, with the development of China’seconomic and the process of urbanizations, Chinese Governmenthas produced various polices about land management systems indifferent periods according to the specific conditions of China,in order to protect the stability of economic situation and findthe appropriate measures of solving citizen’s housingproblems. In1998, China officially entered the era of thecommercialization of real estate market and graduallydeveloped into a completed system of standards and operatingmarket. After ten years’ development and improvement, China’sreal estate market has been one of the main sources of nationalincomes, especially relating to the country’s modernizationand urbanization. But after the beginning of21centurythings were going to especially around2008, China’s realestate market was a little out of control. This mainly refers to the huge increase of house prices and the scope of new housingwhich far exceeded the level of ordinary people can afford.Faced with real estate market’s prosperous situation in recentyears, in the small towns, some urban residents also wanted toenjoy the advantages of financial policies, so they gatheredtogether starting to build houses without the any approval ofthe government departments, which is obvious illegal. Thehouses built by the local people have been used to rent or liveby themselves, but the most important point worthy everyone inour society alerted is that local residents built the house forselling,but in practical they are not professional andqualified at all.(According to the national real estate law,only the professional corporations with the qualificationsgiven by our country have the right to build and sell thehouses).However because of the reasonable and much lower priceof the illegal houses, local residents are happy to purchasefor. Just like this, the illegal houses have found their ownfans. The existence of illegal constructions has been occupiedfor more than half of the total houses in some towns. Althoughin the50s and60s of20century, in order to solve the urban people’s housing problems and promote the process ofurbanization, Chinese government entitled the right ofconstructing houses to urban residents. But with the birth of"Land Management Law" produced in1986, this system began tolose its legal basis and replaced by new designs gradually.It’s no doubt that urban self-built housing comes up againwhich is not normal for a healthy society. In my opinion, theincreasingly growing gap between the rich and the poor whichdirectly devotes to the different abilities of buying housesbetween the wealthy and the poor. Moreover, the lack of thesupervision by government, lax enforcement and failed toimplement national laws effectively are other major reasons.Dealing with the illegal houses, the government will meet somany difficulties that they can never imagine. Thesedifficulties come from not only the people who already boughtthe house or have moved in would try their best to protect their“home”, but also the government that maybe related to theillegal acts. However, the government should not treat theillegal houses the same as the former ones, especially for thosetowns covered over half of illegal buildings.It is a huge waste of national resources, which will lead to more and more socialproblems. Local governments should take into account the realsituation of each town and then try to find the effective wayto lead everything back on the track. This phenomenon reflectssome of the problems in the real estate market which is worthfurther guidance and improvement by our country.
