| In recent years, civil servants with low ranks have become a frequent fieldof corruption cases, although they duties is not high, the power is not big, butthe number is great, and with the grassroots life closely related, so the illegalbehavior of these people on society of the impact of more direct and moreintuitive. However, due to the defects of the system of management at thegrass-roots level and junior civil servants of the characteristics of economiccrime in their criminal behavior is not easy to be found that law enforcementauthorities. Research junior civil servants’ crime cases, explore and analyze civilservants’ illegal disposal characteristics, and puts forward countermeasures toinhibit the crime of corruption "ants" method, carry out the spirit in the18thNational Congress of the CPC, develop combat corruption is of greatimportance to the work.Mainly in economics perspective, this paper focuses on three aspects.Analyzed junior civil servants’ illegal assets disposition characteristic, criminalpsychological behavior characteristics and the downstream of the process ofillegal disposal path, the main content is summarized as follows:Firstly, based on the field investigates and data analysis of the530civilservants with low ranks who have committed crimes and received the trial oftwo City People’s Courts from cities the year2008to2010, we find thatconsumption, investment and deposit in the bank become the main disposalapproaches of their illegal assets. They tend to choose simple, uncomplicatedand popularized methods. Their choice can be explained by three reasons, whichinclude a low level social intercourse, a small number of people with interestconflicts, and the deficiency of their methods and ability to cover their crimes.Directing against these features, this paper reconstructs junior officers’ illegalassets disposal methods.Secondly, based on the analysis of typical cases, this article analyzed the junior civil servants behavior process of illegally accumulating wealth atupstream stage and asset disposing at downstream stage. it considers that thecivil servants criminal mentality is a gradual process; With the aid of costanalysis, it concluded that illegally wealth accumulation can be divided intothree stages: the initial stage that are leading by fear on ambivalence, therampant stage that are leading by greedy and pride, and the turning stage thatprimarily pursuit by spirit benefits; Through the expected utility analysis,obtains the illegal asset disposal link with three stages: from the initial stage thatalmost regardless of the asset disposal to the turning stage that begin to havesecurity needs when choose the asset disposal, again to the peak stage that arepursuit by higher level of demand on the disposal of the asset.Thirdly, on the basis of analyzing the case as well, using risk utility theory,build up the risk cost under the constraint of junior civil servants illegal disposalof illegal disposal path, it draws three conclusions: On the first place, juniorcivil servants of the disposal of the frequency is lower than the high level ofillegal public officials. On the second place, When low levels of illegal civilservants illegal disposal of assets, the disposal of the link is less, although therisk of cost is low, but the illegal assets is not "safe", Their effectiveness issmaller. On the contrary, if disposal links are too much, although the illegalassets is more and more security, because of the risk of cost is too big, utilitycan also be reduced. Last, under the condition of risk cost is very high, low levelof civil servants will end up with fewer links disposal, won’t go for too muchsecurity unlimited time for disposal.Finally, in view of junior public official’s illegal assets’ disposalcharacteristics, crime characteristics and illegal disposal method, the paper putforward suggestions for preventing junior civil servants’ crime. Hope in theaspect of prevention in key areas as well as the detection method of support forthe decision of relevant law enforcement agencies. |
