Research On The Legal System Of China’s Marine Culture

The international community regards the21st century as the century of ocean. The competition between ocean consciousness, marine education and marine science is becoming fierce. Marine culture has received more and more attention. Marine culture is an important part of the cultural soft power. Marine culture, national prosperity and country’s power are closely linked. This paper argues that marine culture is in the process of humans interaction with the ocean, humans are influenced by ocean and interactions with the ocean in the creation of culture. Marine culture includes values, ideology, character, spirit, education, science and cultural heritage.Began in the late1970s, china’s marine legal system entered a rapid development stage. China has make a series of laws and regulations. The marine culture legal system is an important part of our country’s legal system, it is the sum of the marine cultural aspects of the legal norms. This paper from the protection of underwater cultural heritage, marine education and marine science to illustrate the legal system of marine culture. There are many problems, such as the legal system of marine cultural is not perfect, some laws are old, the legislative level is not high, lack of scientific legislative plans. First of all, from four aspects to improve the legal system of marine culture, first to set ocean basic law, followed by strengthening underwater heritage protection legislation, strengthening the marine education, and providing legal protection for the development of marine science. Secondly, to amend outdated laws and regulations, making legal adapt to the development of marine culture. Thirdly, enhance the legislative level of the legal system of marine culture. Finally, in the marine strategy add the planning of marine legislation.
