Since the reform and opening up, our country’s economy is developing rapidly.The thoughts of the Chinese are more open and more and more women begin to work. They have made great contribution to our country’s socialist construction. However, in recent years, there is intensified trend of discrimination of the women who in labor market.This is not only violation of the Labor Law and the Women’s Rights Protection Act,hazardous to the construction of harmonious society, but also harmful to the society.From the discrimination of employment in reality,this paper have studied the causes of this phenomenon and its harm. In reference to the foreign laws of anti-gender discrimination and our country’s basic national condition, the paper disscused the improvement of gender employment discrimination. This article’s main research content is as follows:First, on the base of the definition of foreign theories and our country’s scholars ideas of gender employment discrimination the concept of gender employment discrimination is theoretical analysed. According to this we can summarize and classify the characteristics of employment discrimination.Second, the causes of gender employment discrimination in China and its harmfulness are analyzed. This paragraph studies the causes of the formation of gender employment discrimination in our country ansd analysed the harmfulness binding the reality.Third, according to the existing laws and regulations related to gender employment discrimination, present situation of the gender employment discrimination in our country has been analysed, and the defects of regulations of the gender employment discrimination has been found.Forth, complete legal mechanisms of gender employment discrimination in Britain and the United States is comparaed.We can take the advantages of the UK and the USA to perfect our country’s laws and regulation of gender employment discrimination.Fivth, we must put forward the suggestions to perfect legal regulation of gender employment discrimination according to our country’s basic national conditions and the successful experiences of British and America. First,define standards of gender employment discrimination, safeguard the legitimate rights of those who surfer the discrimination; Next, the gorvernments need to make the anti-gender discrimination act, to remove the defects of existing Labor Law and the Women’s Rights Protection Act; Finally, set up specialized agencies to deal with gender employment discrimination in order to effectively protect victims of gender discrimination.
