On The Duty-rights Asymmetric Of Township Government

Township government as the lowest level of grass-roots government in our country is an important bridge and link plays an inevitable connecting link role between state government and the broad masses of the people , ,and it plays a very important position in China’s administrative system. Township government as the forefront of building a new socialist countryside plays an important role in rural economic and political life. The authority operational mechanisms of Township government whether smooth or not is not only related to rural economic and social sustainable development, but also related to the rural social stability . Township operational mechanism in the new era appear a lot of obstacles, but the most important one is not equality of duty-rights, such as: the township government authority is small but responsibility is big or the responsibility in the Township government but the duty in the functional department of county , so it can’t form a close system between duty-rights,and lead to a serious imbalance of duty-rights.Operational mechanisms of Township government’s duty-rights Separation powers and responsibilities of the township government’s focus on the shrink of power and the expansion of responsibility: the weakening of property, the loss of autonomy and the defect of the control right; The work function is unclear, the workload is heavy and the work responsibility is great. The township government’s power can’t support it’s responsibility is because of the pressure-driven system. Difficulties and importanty of township reform is management system and operational mechanism. I think that wo remold the operational mechanisms of Township government power by surveying and reflecting the reform of Township government in china base on the duty-rights equity and it has important significance.So the overall objective is that the paper base on correlation theory of duty-rights equity and township reform,and apply qualitative analysis in conjunction with quantitative analysis, comparative study in conjunction with case study and canonical parse in conjunction with positive analysis to put forward the countermeasures which can rationalize the relation of the Township government’s duty-rights including the expanding power and reducing responsibilities of township.In the faction of township to expand its powers, the first is to merge township. It focus on an appropriate scale and easy to manage, for example combining small town into big one and poor one into powerful one. The second is the powerful town expand its powers. the key Town-Center should be given affair right and a part of them should be given the county-level economic and social management rights. The third is to enhance financial resources.it must control and resolve rural debt,and the main component of financial management reform is to carry out the the Rural Finance should be managed by County Finance, improve the tax system and increase the dynamics of transfer payment from the exchequer.The Fourth, increased the right of regulation. Straighten out the relationship between departments and regions ,effectively regulate jurisdiction and the power of county departmentsmust be down-passed.In the faction of township to reduce responsibilities: first , distributing county-township affair right reasonablely. in accordance with the law to further regulate the duties and powers of country government,and the scope of offical duty of township government,by the rigid means of law to supply protect for township government and to improve the feed back system of township government work.Second, the reconstruction of the functions. The main functions of the township must to be positioned on social management and public services.Third, the Adjustment of institution. The township will be equipped with all the organization into "a three-run",and add new institutions in conformity with China’s rural society .Fourth, rural governance. The right of participation should be amplified for vast peasantry participating in administrative management, channel off and cultivate civil society growth ,and made public utilities Privatization .
