In China, it has thirty-year experiences in evaluating education, and it has made great achievements. But contradictions and problems are becoming more and more evident. Although our country has issued several laws and regulations on educational evaluation, it is far from meeting the demand of the practice. In order to standardize the practice of educational evaluation, the existing laws and regulations should be modified or repealed and more effective laws and regulations should be issued. According to the situation of the research on our country’s educational evaluation, not only the amount of the relevant essays is small, but also the content of these essays is the simple introduction of the situation of our country’s educational evaluation legislation and the existing problems. And then these essays call for the legislation. This research makes detailed analysis of the situation of our country’s educational evaluation legislation. In order to smoothly carry out the follow-up research, we should have a clear understanding to the problems in the legal system of the existing laws and regulations and to the insufficient of the content. Most published essays discussed on how to make the legal system of the laws and regulations more perfect. This research not only discusses on how to make the legal system of the laws and regulations more perfect, but also takes great effort to find out the problems in the practice of educational evaluation and gives some suggestion to solve these problems. Finally, on the basis of the practice of the educational evaluation of Shanghai, this research puts forward the framework and main points of the educational evaluation regulation of Shanghai. Through the regulation, this research illustrates how to solve the problems in the practice of the educational evaluation.At first, this study discusses the micro-level problems that exist in the practice of the educational evaluation. Only these contradictions and problems are identified, laws to resolve the conflicts and to solve the problems are targeted. The contradictions exist between the Government, schools and community. And educational evaluation itself also has many problems. It is a worthwhile solution that to reconstruct the relationships between the governments, schools and community and to perform their respective duties in the assurance of the educational quality. Then, this study makes the detailed analysis of the existing laws and regulations on the educational evaluation and finds out that there are several problems in the legal system and in the content. Imperfect legal system, insufficient content and low legal effect directly affect the effectiveness of the laws and regulations. The causes are various, and the most important causes are that the legislator’s subjective initiative is not high and the national educational resources are deficient. That the legislative organizations and procedures are not reasonable is another important cause. After that, this study discusses how to perfect our country’s educational evaluation legislation. This study finds out that the conditions of our country’s educational evaluation legislation are premature, so more efforts should be made to accelerate the legislative process. Then, this study puts forward some ideas on how to perfect the legal system of the laws and regulations. At last, this research tries to put forward the framework and main points of the educational evaluation regulation of Shanghai according to the practice of the educational evaluation of Shanghai. This regulation identifies the respective duties of the Government, schools and community and puts forward the rules on the practice of the educational evaluation.
