A Research On The Legal Personalization And Operating Mechanism Of Comprehensive Community Sports Clubs

As a new NPO form,comprehensive community sports clubs,combining fitness、recreation、education with assembly,its aim is to meet the public’s demands of sports and it is an independent government department as well as a non-profit public welfare or mutual benefit organization.This research use the ways of Literature data, questionnaire, Delphi Method, mathematical statistics, field trips and logical analysis,tand takes "NPO legal personalization" as a starting point,through learning beneficial experience from Japanese NPO as well as combing the practice with the comprehensive community sports clubs in Hubei province. This study strives to build the corporate governance model of comprehensive community sports clubs with Chinese characteristics, and designs to build and mature the operation mechanism of community sports which is suitable with realistic and able to effectively guide the practice, in order to offer references to solve Chinese community sports clubs’ business and institutional problems and promote the process of China’s comprehensive community sports clubs accordingly.First of all, this article cards the comprehensive community sports clubs’ origin, definition, characteristic, and explores its operation mode from its values、 effects and popularizing significances.Secondly,I will analyze the nature and legal personalization’s orientation and investigate its collaborative innovation model and is based on it to establish and improve the comprehensive community sports club operation mechanism.Conclusions as follows:(1)comprehensive community sports clubs in our country community is the direction of the future development of sports community organization in our country. It can not only provide a effective way for the career of national fitness, but also realize independent operation.(2)NPO Corporation is the premise of the development of comprehensive community sports clubs, the government could give an independent legal personality and status to comprehensive community sports clubs only to provide the perfect security of legal system good operating environment for its independent moving and financial resources.(3)The corporate governance structure of comprehensive community sports is the theoretical basis of operational mechanism.(4)comprehensive community sports clubs mechanism it the combination of NPO legal-person governance structure mechanism, independent managing mechanism, independent financial ensuring investment, market-oriented operating mechanism, and enterprise mutually beneficial cooperation mechanism and the external supervision mechanism.(5)comprehensive community sports in Hubei province develops rapidly but exists problems.This study proposes some suggestions as follows:(1)lowering the barrier of entry and optimizing legal environment.(2) implementing tax policy and sounding legal system.(3) blending in the community environment and making full use of resources.(4) adjusting the role of government and building a win-win cooperation model.(5) strengthening market operation and improving operational capability.
