Based on the commonly used microscopic investigation methods of ethnology,the Liangtian village, which lies inQiandongnan Miao and Dong AutonomousPrefecture, Guizhou province, is taken as investigation object. The problem of thecommon law on protecting women’s rights was investigated and studied. In theprocess of rule of law construction in China, the existence of the common law has itsrationality and necessity. In order to match the modern spirit of rule of law withcommon law and protect the minority women’s rights, we should use its fortes andavoid its shortcomings, giving it full play to its function. At the same time, the localeconomy, politics, education and so on should also be developed so that customarylaw will catch up with the national law as soon as possible, which will be benificial tothe development of ethnic minority women. This article mainly divides into five parts:The first part, Chinese women’s rights issues involved in common law hascarried on the achievement of research and the summary of theory. The conceptexplored in this paper was defined. A brief description of research methods andinvestigation process will be given in this part.The second part, through the introduction to site situation, let people know aboutpeople’s basic situation living in Miao village of Liangtian, which provides thebackground and comprehensive support of the social, cultural and economic forwriting this paper.The third part, Starting from the Miao nationality customary law, the content ofmiao customary law involved in the knowledge of women’s rights was teased, and thefieldwork fertile fields in the village of the miao’s actual case was analysed tounderstand the local customary law involved in the status of women’s rightsprotection and social influence on the common law relating to the content of women’srights at Liangtian village.The fourth part, in the perspective of the national law, the difficultiesencountered in common law of Liangtian village involved women’s rights andinterests should be treated rationally. Compare the terms of women’s rights and interests in the village customary law with that in national laws, from which to findout the accordance and conflict. The specific problem was analysed specificly to makereaders have objective view on current status of women’s protection rights andinterests at liangtian village.The fifth part, the related problems existed in f the Miao women’s rightsprotection, especially the problem of the women’s rights on Chinese originalecological ethnic minority region, has certain reference value. As for the solution ofthe problem, the author gives some relevant countermeasures and feasible idea.Studying a problem, the best way is to learn deeply. In line with this principle,the author visited at Liangtian village to survey and investigate the local customarylaw involved in the content of women’s rights by case analysis. The primaryrequirement is to treat common law objectively, which is also an important strategyfor protecting women’s rights in the local region.
