On The Construction Of The Rural Land Securitization Mode Research

The rural economy achieved a steady development in recent years. Butthe "three rural" issue is still the focus of national attention. This articlebased on the development needs of the growing rise of rural land scale,mechanized business trends, the voice of rural land circulation acceleratingpace of innovation requirements of the existing rural land system constantly.The paper tries to concept the financial innovation, securitization of land inour country.In the introduction part, this paper first introduced the rural landsecuritization practice experience in the Germany, the United States andJapan and other countries, including the system background of the landsecuritization, operation process, related policies and legal content. It alsohas a brief description on the farming land system of our country, the newagriculture policy, securitization practice. Through the comparison of thedomestic and foreign rural financial development level, I summed upChina’s rural financial development lags behind, lack of experience of assetsecuritization, and financial development of rural land still exist.Then, the core part of this article draws on models and theories offoreign rural land development of asset securitization, starting from theexisting rural land system and practice of agricultural land shareholdingcooperative system basis, the securitization model of agricultural land tobuild the analysis, includingrural land mortgage debt securitization modeland rural land investment in equity securities mode, and then discusses theChina rural Land Securities existence of legal and institutional issues,discuss the order from the macro-rural collective land system arrangements,to the securitization of agricultural landmicro-legal obstacles, in the mainbuilding risk prevention system to the agricultural land securities encounterproblems, the last part on relevant legal issues and put forwardcountermeasures and suggestions..
