Study On The Circulation Of Collective Constructional Land

The circulation of rural collective constructional land is not only the important content of rural land reform, but also the focus of the issues about rural land. It is related to development and stability of rural economy and society. With China’s rapid economic development, the circulation of rural collective constructional land has been quite common, the scale of the circulation has become larger and larger, and the activities of the circulation have become increasingly frequent. However, the imperfections of relevant national laws, regulations and policies make the management of collective constructional land chaotic, conflicts caused by the circulation of rural collective constructional land have become more and more, which brings a series of socio-economic problems.Therefore, solving the problems of the circulation of rural collective construction land is imminent. Improving the mechanism of the circulation of rural collective constructional land relates not only to the interests of farmers and social stability, but also to the course of the construction of new countryside and rural modernization,and even to the sustainable development of the national economic and society of our country.At present,the problem of the circulation of rural collective constructional land has become the current major issue, which raises the common concern of the experts and scholars in whole society.To solve the practical problems existed in the circulation of collective constructional land,and to meet the practical needs of market circulation of collective land for construction, this paper clarified the underlying concepts concerning the circulation of collective constructional land, analysized the current phenomenon of the circulation of collective constructional land in depth, and described the characteristics, the forms, the patterns presented by the circulation,the adverse impact of the circulation and the causes of such problems arising from the circulation.Then, the paper analysized the pilot work of Wuhu City in Anhui, Anyang City in Henan, Suzhou City in Jiangsu, Guangdong Province and Hunan Province from the angle of Comparative Law, and introduced the circulation system of the rural land in the United Kingdom, France, the United States, Japan, Korea. Next,the paper extracted the useful enlightenments and references which are beneficial to the improvement of the circulation of rural collective constructional land of our country. On this basis, the paper explored the establishment and improvement of the basic system of the circulation of collective constructional land in our country based on the actual situation in China and combined with the advanced foreign experiences. In order to establish and perfect the system of the circulation of collective constructional land, the paper proposed the feasible ideas and practical solutions.Finally,the paper put forward concrete countermeasures and suggestions to establish and perfect the mechanism of the circulation of collective constructional land.
