| In china, the village committee which is autonomous mass organization at the grass-roots level provides an interface with the township governments which is the most basic state power. The power division between them matters the implementation of villagers’ autonomy regulation. The interrelation between village committee and lower-level governments should be stipulated in law, which is stipulated in The Constitution of the People’s Republic of China Article11. The village committee organization law basing on Constitution concretely stipulates the power of village committee and the power division.The relation between the village committee and township governments is designated in Article5---township governments guide, support and help village committee to carry out the work, should not intervene in the autonomy range of village committee, and village committee assist township governments. In practice, the system is problematic because the legal regulations are principled, abstract and inoperative. The interrelated content on legalization of the relation between the village committee and township governments is elaborated in three parts, and interrelated improving opinions are proposed on the power division between the village committee and township governments.In the first part, the power division between the village committee and township governments is elaborated, the source, property and status quo of village committee power, and the significance and foundation of the countryside state power and village governance is analyzed. In the second part, the other countries’ power division situations, including America and Japan are presented, and through the analysis, China should use the experience of other countries for reference in the aspect of legislation. In the third part, the weakness of the legal system is proposed on the power division between the village committee and township governments in China, improving measures are put forward on this question. |
