Research On China’s Legal Protection Of Volunteer Service

Volunteer service originated from western charity activities in the19thcentury.During the hundred years of development, western countries learnt from the past anddedicated themselves to improve the legislation. With unremitting efforts, volunteerservice in western countries is now becoming systematic and institutionalized underlaw. Volunteers improve themselves and achieve personal social value by participatingin the service, while at the same time the country cultivate the citizens’ sense of socialresponsibility and promote the social and economic development of civilization byadvocating it. Volunteer service benefits both the people and the country. In order toguarantee the development of volunteer service, the country has to provide legislativebasis for it.Compared with the western country, volunteer service in China is relativelybehind. Development of volunteer service in the modern sense starts late，though wehave the spirit of volunteerism for a long time. However, thousands of volunteersappear in large-scale sport events and summits which attract people’s attention onvolunteer service. This essay is based on the research on the theory and practice ofvolunteer service and tries to learn from the west to promote the establishment oflegal system on it. This essay is divided into four parts as follows:In the beginning part, the author gives a brief introduction on the history ofvolunteer service and explains the method of research. The first chapter mainly talks about the definition, features and the classificationsof volunteer service, and elaborates on some relative principle of economics in thisfield.In the second chapter, the author analyses China’s current situation of legislation,referring to the importance of legislation on volunteer service.The following chapter looks into the advanced legislation on volunteer service inAmerica, Germany and Taiwan province to find out the advantage. By comparing thelegislative situation, the author sums up shortage of legislation.In the last chapter, which is the corn part of the essay, the author comes up withsome solutions to perfect our legal protection of volunteer service in broad，emphasizing the importance of legislation on volunteer service and gives three piecesof advice on legal protection of volunteer service including strengtheningmanagement on volunteer organizations, establishing a system of encouraging anddefining the liabilities and remedies for torts in volunteer service.In conclusion, China should seize the best chance to construct a legal protectionsystem for volunteer service.
