The nuclear waste is radioactive or contaminated with radioactive substances discardsinvolving nuclear reaction is bound to generate nuclear waste, while most of thenuclear power generation process generated the largest number of nuclear powerwaste. The early use of nuclear energy for peaceful purposes, it is almost a blindlyaccepted attitude to face the scientific community and the government are fullyexternal to promote the use of this new energy. But as time goes on, the seriousconsequences of the nuclear energy waste is gradually revealed. Nuclear waste andother industrial waste, human activities produce waste, it is radioactive, and willcontinue to produce high-energy radiation, damage to life forms and the environment.The length of the half-life of the radionuclides, radiation and contained in accordancenuclear energy waste and there may be quite a long time, far more than the averagehuman life expectancy. If nuclear waste is not properly handled, contained radioactivepossible through the atmosphere, water flow across borders affect neighboringcountries, triggering international disputes. Nuclear energy due to its radioactivity,and nuclear energy use, waste handling is not limited to nuclear energy, the country’sinternal affairs, and must accept the international norms. The face of widespreadanti-nuclear wave sound, how to actively resolve the rational communication is thatpeople must be careful to face; addition, properly handle nuclear waste is an importantissue in international law, there are still many bottlenecks to be scientistsbrainstorming, to continue the pursuit of innovation, and beyond.This paper described starting from the concept of nuclear waste, and then leads to theneed to properly deal with nuclear waste. Secondly, the existing legal basis fornuclear waste disposal, including the the developed international Convention, therelated regulations drawn up by the International Atomic Energy Agency as well asthe typical country’s relevant legislation, to learn about the nature of the nuclear wastedisposal as well as experience in handling. Although different countries on the use ofnuclear energy, attitude and practice of dealing with nuclear energy waste is basicallysimilar, can be used as a reference for our use of nuclear energy should be how to dealwith the nuclear waste problem. Next absorb and learn from existing research basedon this article from the perspective of international law to perfect the mechanism ofnuclear waste disposal laws put forward a four-point proposal. First, the establishment of an independent oversight body, external checks and balances on the processing ofnuclear waste; Second, improve the national responsibility, the national response tothe transaction within its sovereign responsibility; Third, to strengthen internationalcooperation, capital, technology and information exchanges and consultations; fourth,to establish a compensation system, protect the legitimate rights and interests ofvictims. The last part is the end-result of this article, that the legal system of thenuclear waste disposal, the legal basis of the analysis of the Chinese in dealing withnuclear energy waste from the Basic Law of the development of the nuclear field andrelated legislation, the provisions of the medium-and long-term assessment systemmodify the contents of the legislation in a timely manner and improve the system ofcompensation in four areas to make reasonable suggestions.
