The Appraisal And Improvement For Standardization System Of Law Enforcement In Xi’an Urban Management

Standardization of law enforcement refers to using programs to constraint the lawenforcement behavior, using refine standard to compress the elastic space from the right ofdiscretion, using the ultimate force of justice and the payment of the cost of breaking the lawto implement effective management, thus to drive the whole work system regression bytransferring from ordinal administrative management mode to real significance legal mode.Since the implementation of standardization of law enforcement, Xi’an has made importantachievements. But the short time of implementation within3year, the standardization systemof law enforcement still exist many problems and the works have much improved space. Now,many people complain the work from urban management and law enforcement, so it is animminent thing to improve standardization of law enforcement. Standardization system of lawenforcement is referred to as works and the implementation process. The appraisal ofstandardization system of law enforcement means to judge its implementation effect inessence, thus to determine the identification and satisfaction to the works from the citizens.This project aims to using a method to appraisal standardization system of law enforcement,and obtain its implementation effect, thus discover the problems. Based on such problems, wepropose the implement policies for Xi’an city to improve the work suggestions.Based on the review of related research situation in urban management and lawenforcement, we first clear the aim of standardization of law enforcement and summary thepractice experience. Secondly, the running situation of standardization of law enforcement hasbeen analyzed and the experience has been reviewed. Thirdly, we make a summary to theeffect in the cognition that people takes to standardization of law enforcement, the cognitionthat people takes to law enforcement team, and the effectiveness of law enforcementstandardization by survey research method, which provides us many perceptual know ledges.Fourthly, we present the preliminary evaluation indexes for standardization of lawenforcement by literatures summary. The selection is done to determine the ultimate indexes.We use the Grey Hierarchy Analytic method to complete the appraisal of standardization oflaw enforcement. The results show that the appraisal of the general situation and seven one-bank appraisal indexes. The general situation is medium. Discretionary refinement andthe platform for law enforcement are good. The separation of powers shows bad. The otherone-bank appraisal indexes are medium. Fifthly, for the indexes with medium bank and badbank, we analyze the form of expression and detail reasons. Finally, we present theimprovement policy for propaganda work in standardization of law enforcement, theimprovement of law enforcement team assessment, the coordination with related governmentdepartments and citizens, the improvement of transparency in enforcement process and thenew mode of urban management for existed five problems.
