Empirical Study On The Functions Of Local Police Station

Local police station is the agency of public security organ in China and is at thebottom level of public security organization system. It faces and serves the peopledirectly, and it is the most intuitive, the most concrete and the most persuasive link inthe law enforcement work of public security. It undertakes a large amount of basicwork such as population management, case processing and so on, and it is thefootstone of the whole public security work, therefore, the effects of its functiondisplay have a significant impact on the whole public security work and the image ofpublic security organ among the people. However, the function of local police stationis not displayed to the largest extent in real practice but restrained by many factors,which threatens the harmony and stability of the whole society. Although there aremany penetrating elaborations on the system and function of public security at home,these elaborations are mostly based on theory construction, having no practical andsignificant guidance on the concrete development of the work of police station.In this thesis, taking PY police station as an example, the functions and thesituation of function display of local police station are investigated by combiningtheory and practice. Under specific legal and historical background, the function ofPY police station can be summarized into11items. In terms of actual developingcondition these tedious and heavy functions are not performed very well. That thefunction display of local police station is in the face of great challenges is evaluatedbased on the principle of legitimacy, rationality and efficiency in administrative lawenforcement, from the perspective of administrative legislation.The obstacles restricting the function display of local police station are alsosummarized in this thesis: the management system of Integrating Departments andRegions at Different Levels in public security organ controls the finances of policestations at grassroots level and makes them undertake a large amount of non-policework, which occupies the limited police force; the wide range of service functionshave an impact on the basic work of police station at grassroots level, causingconflicts between police and the people; the lack of protection on the rights and interests of policemen threatens the right of life and human dignity of them, reducingtheir enthusiasm for work; the insufficient police force in local police station and theincomplete system of auxiliary police force make it difficult to finish heavy load ofpolice activities; the unqualified professional qualities and the absence of asupervision mechanism both reduce the efficiency of work. Analyses of practicalsignificance are conducted on the constraints combining the actual condition of thework of PY police station.Based on the analysis on the obstacles constraining the function display of localpolice station with the real situation of PY police station being taken intoconsideration, some countermeasures are put forward and analyzed in this thesis, withthe expectation that the functions of local police station can be realized in a betterway in practice, which is the focus of this thesis. Firstly, the management system ofpublic security organ shall be straightened out objectively through changing themanagement mode of Integrating Departments and Regions at Different Levels,adhering to the vertical leadership of public security organ and establishingregulations and laws in a completed way as well as offering some space to publicsecurity organ for independent law enforcement with the premise that there exists acompleted supervision system. For police stations at grassroots level, the key is tostraighten out their relationship with public security organs at higher level and otherlocal government organizations. Concerning internal management, functions ofdifferent departments in a public security organ shall be specified in a reasonable wayand the approach and focus of the guidance provided by authorities at all levels shallbe specified clearly, which should lead to the reduction of direct intervention to policestation and makes local police station enjoy the dominant position with functionsbeing matched with powers. Service functions shall be specified; a clearresponsibility mechanism shall be established; the promise of non-police functionsshall be amended; cooperation between police station and other governmentdepartments shall be intensified; linkage mechanism of all functional departmentsshall be established and completed and each department shall perform its ownfunctions and take its own responsibilities; the service of social management shall beintegrated into the category of comprehensive treatment of public security. And the efficiency of mediation work shall be improved through the adoption of an efficientorganizational form. The awareness of protecting the law enforcement rights of thepeople’s police shall be enhanced; legislatures should promote the amendment andcompletion of the existing laws on police and the legislative procedure on theenactment of special protection law; the proper rights of policemen shall be specifiedthrough legislation and laws shall become the most powerful weapon for protectingpolicemen’s law enforcement rights. The allocation of police force at grass roots levelshall be optimized and a pyramid-shaped allocation of police force shall be realized;and the system of auxiliary police force shall be improved and completed, which shallsubstantially reduce the pressure caused by the insufficient police force at grassrootslevel. The policemen’s knowledge on laws shall be increased and a completesupervision mechanism shall be established; the work efficiency of local policestation shall be improved, while the misuse of power shall be heavily restricted.However, to change the current status of function display of local police station is nota once-and-for-all task, but a long-term job that needs continuous adjustments basedon the reality at work.
