The Research On Legal Supervision Of Chinese Government To The Private Enterprise

Till now, more than one year has passed the Japan’s311nuclear leakage caused by the earthquake and tsunamis.Nuclear radiation not only brings the Japanese hidden trouble threating the body health, but the omission of Japanese government handling the accident affects directly the living style and mental status of Japanese. This event has reflected the supervision flaw of Japanese government to their enterprises, so we have to take a new look at the relationship between Japanese government and enterprise under the market economy. This thesis discusses the merit and demerit of Japanese relationship between government and enterprise, the problems faced our government and enterprise relationship. On the basis of drawing lessons from foreign countries, it puts forwards some advises on improving the effective legal supervision of government to the enterprise. Further research on how to construct the clear function, independent organization, strict accountability mechanism, modern multidimensional supervision system will coordinate the relationship between government and enterprises, give full play to the free market competition and the role of the government’s macro-regulation, match again with the sound legal system, so as to achieve the optimal allocation of relationship between government and enterprises.By combining application of case analysis, comparison and literature analysis, the main content of this text includes three following chapters:The first part defines the concept of private enterprise, analyses the existing supervision problems of Japanese government to the private enterprise; the second part focuses on the legal supervision status and problem analysis of Chinese government to private enterprise; the third part puts forwards some countermeasures in law supervision of our country to private enterprise by the legislation construction and system construction.
