The topic of three public consumptions has been always in dispute in our country,the pay of government cars ranks the top of three public consumptions,the great costis horrifying. The large number and the unreasonable existence of government cars,the upgrade of the level and configuration arouse heated public debate. Withpenetrating into concept of the rule of law and the construction of socialist democracy,all kinds of problems about the official vehicle-using system gradually emerge.Government car-using for private purposes, swelling consumption on official vehicles,super system and excessive emission, these phenomena do not stop despite repeatedprohibition. Official vehicle-using system is, so to speak, suffered criticism form thepublic. As a result, reform of the vehicle-using system is put on the agenda. Since thenineteen ninties,the voice of vehicle-using system reform grows louder and the wholenation is setting off an upsurge of reform from above to below. The various ministriesand commissions under the State Council promulgate a series of policies to specifywhich kind of cars can be purchased and equipped. At the same time, many provincesand districts are eager to explore the path of reform and put forward different schemes,such as the monetization model, management-strengthing mode, themarket-oriented mode. Even though these measures achieved some success in thebeginning, the process is still slow for some reasons, the reform tide quietly retreatand the problems about official vehicles have not been fundamentally solved at theend. In this regard, taking the system as a point, this paper probes the current officialvehicle-using system in our country on legal area with the aim of marketization.Through the establishment of rigid legal system, accountability system andrestrictive mechanism for power, the article aim at redress the wrongs of the officialvehicle-using system and push the process of rule by law forward.The body of the thesis is divided into four chapters in addition to the epilogue. Thefirst part of the article introduces the development and the reform process of theofficial vehicle-using system from policy to practice since1990s. In the meantime. several main reform model, including the management-strengthing modemonetization mode, and the market-oriented mode are compared. The second partdiscusses the drawbacks, like the excessive expenses and heavy fiscal burden, supersystem and excessive emission, private use of government vehicles and so on, existedin the official vehicle-using system, beyond that, this part analyses why the reform ofofficial vehicle-using system fail from value idea and institutional deficiency. Thethird part,on the one hand,is the introduction about the official vehicle-using systemin the United States, France, Germany, Britain and other countries, on the other hand,is some insights given by foreign system. Part four, that is the last part, based onsetting forth government cars’ adscription in law and target for reform, points out thatofficial vehicles should be classified into cars for special purpose and regular use. Toofficial vehicles for special purpose, government by law is necessary. At present, weshould establish rigid legal system, accountability system, restrictive mechanism forpower and perfect supporting measures to fully ensure the reform of officialvehicles in law aid. To official vehicles for regular use, the road of market is thefundamental choice. In short, the reform of official vehicle-using system gives firstpriority to market-oriented mode and second priority to the rule of law.
