The Research Of County Land Law Enforcement Supervision’s Present Situation And Countermeasure

Land carries everything, thus become the space and place for human’s life and production activities. Land issue has a great impact on social stability and economic sustainable development in our country. The land law enforcement supervision is to maintain the land management and land market order, a fundamental way to promote the sustainable utilization of land resources. Recent years, with the soaring urbanization process, the contradiction between economic development and urban land are more prominent, and the land law enforcement and supervision are also in the dilemma that "difficult to find, hard to stop, investigate and punish". How to figure out the complex situation and find a balance between the economic development and land protection becomes a very important subject.This article discusses the research purpose and method, concept and theoretical basis of the land law enforcement and supervision. On the basis of making the comprehensive analysis of the status situation of land law enforcement and supervision at home and abroad, this article using the method of field investigation, case analysis, literature research, and comparative analysis and combining the county level of the municipal work condition of the land law enforcement supervisory departments that the author worked in.Through the comparison of illegal land use between city and county administrative areas, the types of main illegal land in County area are lands for commercial services, industrial and mining warehouse, residential, public administration land, public administration and public services, and transportation. Illegal types are mainly in the forms of using without application or using and application at the same time. The proportion of illegal land use of the total areas of new construction land expanded year by year. In2011, the ratio of illegal land use for total new construction land area dropped slightly in Xupu County, but the ratio is still considerable. The effect of land law enforcement and supervision in Xupu county is remarkable in recent years, especially the illegal area reduced year by year, it shows that they pay more attention to the land law enforcement supervisory work, and effective measures were taken, so the result is significantly. In recent years, there is no the phenomenon of illegal land, it shows that the government can supply the land legally. Meanwhile there are some problems, such as the serious shortage of funds during the land law enforcement supervisory work, and imperfect laws and regulations in law lead to the supervision strength is not enough, so the effect is not very obvious.At last, carried out a detailed analysis of the existing problems and offered the strategy and solution of optimize the land law enforcement supervision at the county level looking forward to provide references for land policy makers.
