In the21st century, economy and culture with unprecedented speed develop. The improvement of living standards and quality of life makes people’s more and more demand for energy. When people in the pursuit of a comfortable life environment and living environment, they also need to face the building energy conservation problems. Meanwhile, the energy crisis has made many developed countries recognize the importance of energy conservation. In the process of evaluating energy consumption, the proportion of building energy consumption accounts for a third of the total energy consumption ratio, and the trend continuing to rise. Then, building energy conservation problems come into people’s horizons. Developed countries have begun to pay attention on the problem of building energy efficiency, and by formulated a series of laws, regulations and policies to restrict the building of high energy consumption problem, then come up with a building energy efficiency targets.China started late in the issue of building energy conservation. Since2000we began to pay attention to the problem. But as the energy resource consumption the main part of the building, we have no specialized law of high potency to restrict and regulate. This topic is put forward in the face of that the legal system of building energy saving is not perfect and the related laws and regulations on. In this paper, establish and perfect building energy law system is the main research direction. Through the comparison of contrast America and Germany in two developing countries on the issue of building energy conservation legislation, this paper will find advantage in developed countries in building energy-saving aspects, and in these advanced and perfect legislation mode for our reference. Through reading and screening a lot of literatures about building energy saving, we discard the dross and select the essential, scientific literature as the basis for this study. Through the comparison of extraterritorial on the issue of building energy conservation regulations and legislation mode, we choose the most suitable for the situation of our country practices. By combining the relevant theory of economics, environmental science of improving the legal system of building energy saving in China and provide a theoretical basis. The combined use of these methods make the paper formed a relatively complete system of structure.The innovation of this paper is that it uses the environment cleaner production theory and the theory of sustainable development to analyze the necessity of theoretical basis on energy saving of construction industry. Considering the benefits of building energy saving and the use of tax leverage to stimulate the behavior principle of building energy saving theory from the angle of economics, it also uses the theory of transaction cost and tax incentive theory. In addition, in the process of the current situation of China’s building energy efficiency analysis and look for the countermeasures, this paper also proposed a more novel suggestion. The interdisciplinary theoretical analysis as the foundation, the building energy-saving legislation comparison and selection America, Germany and Japan three countries, and combine the reality of our country, the author comes to a conclusion as follows: China’s building energy efficiency policies and legislation is not enough; the administrative regulations is perplex; uniform regulations is lack; no provisions of building energy efficiency standards and improve the evaluation standard, value and social questions about building energy conservation is not enough. In view of the above problems, this paper also puts forward the corresponding countermeasures, through perfecting legislation, building energy-saving building energy labeling system, formulate energy-saving standards appropriate, perfecting the legal system of building energy conservation.
