On The Theory And Practice Of Chinese Human Rights Protection Since Reform And Opening Up

With the development of the world democratic politics since the twenty-first Century, all countries have attached great importance to develop democracy and the legal system, especially to the respect and protection of human rights, so the issue of human rights has become an important problem both in the development of the world democratic politics during the twenty-first Century and in the internationally political exchange and cooperation that each country participates in. Before the reform and opening up, China, based on the different social nature and the biased recognition, had drawn a strict line with capitalism and believed that civil rights, rather than the production of capitalist—buman rights should be paid attention to in the socialist countries; Since the reform and opening up, Chinese Communists have started to realize that the problem of human rights also existed in the socialist society because of the constraint of productivity level.Nowadays,owing to the objective and correct understanding of human rights issue, China has gradually stepped on the right track in the cause of human rights protection. The Third Plenary Session of the11th CPC Central Committee was a milestone in the the cause of Chinese human rights protection, after that the Chinese government has released ten white books about the situation of Chinese human rights and put this regulation—the state must respect and protect our human rights into the constitution, which has the epoch-making significance in the enterprise of Chinese human rights protection.Totally, this paper is made up of four aspects:first,it takes the thought of human rights contained in the Marxism and Mao Zedong Thought as the theoretical basis and draws lessons from the Western human rights theory; second,it analyses and summarizes the significant achievements in the cause of Chinese human rights protection since reform and opening up; third,it deeply analyses the problems and reasons of the Chinese human rights protection and finally proposes the related strategies and makes the scientific predictions for the development of Chinese human rights protection in the future. The theoretical research comes from the need of reality and aims to solve the realistic problems; This thesis, which can be divided into six chapters and all of them are linked with each other and successively expand, enlightens the reader from two aspects:on one hand, we can not ignore the economic development in society as in the Western countries to realize the human rights—a gradually improving process; on the other hand, we should not pay less attention on the cause of human rights protection because the realization of human rights is constrained by the social economic conditions.Therefore,in order to effectively promote the healthy development of the cause of Chinese human rights protection, China can strengthen its endeavor from two aspects:externally,it ought to effectively refute the theory of human rights related to the Western hegemonism and increase the persuasive power of Chinese human rights theory;internally,it should enrich the innovation of its human rights theory and steadily protect the human rights by putting forward and implementing the feasible countermeasures aimed at the realistic problems.
