| With the development of shipping and logistics industry, shipping logistics operators gradually expand the scope of their services. Meanwhile the risks born by the shipping logistics are also growing. Therefore, shipping logistics operators are in urgent need of logistics insurance to divert the risks in logistics activities. However, it is difficult for the traditional logistics insurance to meet the needs of shipping logistics operators. And also there is a big gap between the existing terms of logistics insurance and the needs of shipping logistics operators. Only by providing suitable shipping logistics liability insurance and solving a series of legal issues, could we promote the development of shipping logistics industry further. This article focuses on some legal issues of shipping logistics liability comprehensive insurance.This paper is divided into four parts:The first chapter provides an overview of shipping logistics liability comprehensive insurance. First, this chapter defines the meaning of the shipping logistics liability comprehensive insurance. Then it analyzes the differences between shipping logistics liability comprehensive insurance and other similar insurances. Finally, it introduces the current development.The second chapter studies the main parties and the main contents of the shipping logistics liability comprehensive insurance contract. Then it introduces the insurer, the insured and risks covered.The third chapter analyzes the main legal issues that the shipping logistics liability comprehensive insurance involved, including the existing laws and regulations, and conflicts between the "Pay to be paid" clause and the third parties’rights against insurers.The last chapter suggests building the legal system of shipping logistics liability comprehensive insurance. This chapter puts particular measures and suggestions to it. |
