Pre-primary education is a significant part of the national basic education, in furthering the individual comprehensive development, elevating the national quality, enhancing the quality and efficiency of education, which is provided with a ground-breaking significance.Taiwan and the mainland share the common roots, the same clan with pulse, cultural and educational traditions come down in one continuous line, Taiwan’s pre-school education legislation is likely to face similar circumstances with the mainland. This dissertation seeks to analyze and research pre-school education legislation in Taiwan, which is combined with the existing pre-school education situation and problems, to propose suggestive legislative proposals in the mainland.Full-article is divided into four sections:Part Ⅰ briefly expounds the origins of the study, sets out the theoretical and practical significance of the research, sets forth the train of thought and research methods in the study, and defines important concepts.Part Ⅱ presents the history of pre-primary education legislation in Taiwan. According to time order, Taiwan pre-school education legislative of development will be divided into five stages, late Qing imitated Japan day-sprout period (1895-1912); early Min imitation of US-change period(1912-1922); Republic of11-formed period (1922-1949); after Republic of38Government moved Taiwan-development period (1949-1975); after Republic of62-stability period (1975-nowadays). This dissertation focus on each stage within the Taiwan area evolution of pre-school education laws and regulations, from the ideology of legislative guiding and the main legislative body, etc. to analyze basic characteristics of every stage of pre-school legislation education in the Taiwan area.Part Ⅲ elaborates and analyzes explicitly pre-school education legal system of Taiwan. On the basis of expounding Taiwan pre-school education law system, as well as the importance place of pre-school education legislation in Taiwan pre-school law system of education, mainly deciphering and analyzing the purposes and objectives, admission part object, scope, standards and procedures established, composed of standards, curriculum and equipment, administration and teachers ’qualifications, pay and bonus stipulations. Concluding the pre-school education legislation characteristic of Taiwan area, as attaching importance to pre-school education legislation, sound legal system, legal content of specificity, operational, legal stability and continuity. From a legal point of view to analyses Taiwan’s guiding ideology and basic principles of pre-primary education legislation, functions and content characteristics, which summed up experiences and lessons learned in the building legal system, and provide reference advice in setting up the law on pre-school education in mainland China.Part IV concentrates on analyzing the enlightenment of Taiwan pre-school education legislation to the Mainland. Beginning by reviewing status of pre-school education legislation in the China mainland, analysis of the conspicuous problems in pre-school education legislation and attribution, namely lack of pre-school teachers law lead to low quality teachers; Shortage of pre-school management act leads to the non-specialization of teachers; Lack of pre-primary education law input leads to unreasonable responsibilities; Lack of pre-school education law causes specifically the missing of specifically guaranteed law. Response to my above question, drawing on the successful experiences of Taiwan’s pre-school education legislation and lessons, from preschool education reform and development through legislation, improving the system of the education law, enacting the pre-school education law, this dissertation will proposes recommendations to strengthen the operational policy of pre-school education legislation in the three dimensions.The last part is a summary of the research. This dissertation takes Taiwan pre-school education legislation as research object, By research of Taiwan pre-school education legislation of history evolution, and legal system and content features, summary of experience and lessons Taiwan pre-school education method construction, deriving Taiwan pre-school education method construction in the active results to help us develop pre-school education law, to evaluate the national’s quality of pre-school education legislation, to provide reference to establish a set pre-school education system of China features, and impel the nation’s education legal system to be built up in a constantly perfect pattern.
