A Study On Ecological Environment Development Right In Ethnic Arear

This is a representative and typical case analysis which proves that the system andmechanism of ecological development in ethnic minority areas in our country has had a certainbasis, but the implementation of ecological development rights still has problems andobstacles.Thus,this paper also puts forward countermeasures and suggertions of the ecologicaldevelopment rights protection of minority areas.For China, a multi-ethnic country, effectiveguarantee of ecological development right in ethnic minority areas and further improvement of themechanism for ecological development right in ethnic area, has profound theory value andpractical significance for the maintenance of prosperity and stability in the ethnic area.This paper consists of five parts: Part1:The fundamental theory of "ecological environmentdevelopment in national regions" was discussed. First, based on the theory of the developmentright, this paper analyze national development followed by present the concept of ecologicaldevelopment in national regions, and emphatically expounds the connotation of ecologicaldevelopment in national regions (including the subject, object, content), the core and valueorientation, positioning right attribute and its legal origin, legal nature, theoretical foil, just forhaving a theory foreshadow for the following chapters.Part2:“significance of realizing ecologicaldevelopment in national regions” was expounded from the realistic meaning and law meaning,respectively. Realistic meaning mainly is consist of conducive to the stable sustainabledevelopment in national regions, consolidate the ethnic relations of equality, unity, mutual aid,promote the national common prosperity, is advantageous to the comprehensive well-off society innational regions and the realization of the national harmonious society built. Through the studyingof ecological development in national regions, law meaning contribute to national legal systemconstruction of sound and the improvement of ethnic ecological protection law concepts.Part3:the conservation status and characteristic of ecological development in national regions wasdescribed. According to Enshi tujia and miao autonomous prefecture of ecological constructionsituation of first-hand data from enshi research development and reform commission and othergovernment departments, this paper summarize the conservation status and trait of ecologicaldevelopment in enshi autonomous.Part4: the practice of "enshi ecological development rightsprotection and its experience and enlightenment" was summarized from the government support,public participation, the perspective of enterprise cooperation, ecological education, academicresearch to parse the enshi to protect the concrete practice of the ecological development in theregion. And on this basis play a positive reference for other ethnic areas in our country theprotection of the ecological development.Part5: the paper analyzes the problems existing in theenshi ecological development, and puts forward the countermeasures and suggestions. Based onethnological fieldwork method and field survey, the realistic obstacles in the process of ecologicaldevelopment protection mainly include: administrative supervision vacancy, some peopleconsciousness of environmental protection, protection fund shortage, imperfect legal system of protection and the conflict between ecological protection and economic environment development.In order to solve these problems, the author put forward the feasible concrete countermeasures andsuggestions, especially when dealing with the contradiction between ecological protection andeconomic development. The effective strategy was suggested as follows: a clear developmentorientation; strictly carrying out the ecological red lines; the development of ecological industryproject; establishing a comprehensive compensation mechanism; the implementation ofcomprehensive poverty alleviation; developing new type of urbanization.
