The development of urbanization will greatly increase the population accumulating in the urban space, will make the land more intensive, will make the amount of farmland stable, and make the land efficiency. But now in China, the continuous progress of urbanization dramatically makes the number of agricultural land reduce, and rural residents per capita homestead area is increasing. Some rural villages are expansion and more abandoned homestead. Some farmers with a substantial increased income started to expand or build a new existing housing beyond their own homestead area. Building a mechanism of the rural residential land quitting can get rid of the urban-rural dual structure and make the elements activate between urban and rural area. Without increasing the total amount of land for construction, it can relieve the contradiction between supply and demand of land, and also keep the red line of arable, and ensure the food safety.Firstly, the study analyzed relevant laws with homestead use right. Then the study explained the allocation of land elements of welfare issues from an economic point of view. Building a rural land use right mechanism is feasible and economic in the current China, especially in the area of urban and rural economic development. The primary problem of rural land use right of withdrawal is the compensation. Considering the value of the homestead and the reference of existing local government compensation standards, a calculation of compensation is contributed in the study.Through the study of Wenjiang District, it is clear that:â‘ the quitting of rural residential land is legal and economical;â‘¡the compensation standard for houses and structures on the homestead can be reference to the local land requisition compensation standards. But the compensation of rural land use right value must basis on the value, and then reference to the same area of state-owned construction land value, and then comprehensively determined by thoroughly and carefully assess. However, the quitting of rural residential land still exist many problems:the principle must "in line with the planning, voluntary participation, steady, progressive, legitimate and reasonable compensation". And the compensation of farmers should be guaranteed. The manner and content of the compensation can be different by the wishes of farmers.
