Construction Claim should be disposed in accordance with the laws and the regulations. But now increasingly complex construction project technical requirements caused the increase of construction difficulty, and the quota valuation mode transformed to the list valuation mode, which are the reasons of the new claims. The contractor in the engineering in the past often practice the low-price bid, high claim to maintain their own interests, but the owners have no rich experience in the claim, so the two sides will produce controversy on certain issues. On the perspective of the owner, this paper compare the quota valuation mode with the list valuation mode, analysis the new specification of the valuation of the claim, to provide theoretical support for the owner’s claim management. The study is to safeguard the legitimate rights and interests of the owner, is conductive to regulating the competition of construction market and the parties, to guarantee the engineering quality and progress.This paper at first introduces the overseas and domestic research status of construction claim, the conclusion are the research about claim under the bill of the valuation is obtained less and the research about cost is obtained less; and introduced the theoretical basis. Then this paper expound the identification and response of construction claims based on the mode of valuation with bill of quantities, including the difference between the list valuation with the quota valuation mode, the composition of claim expenses based on the list valuation, the new rules of the claim under 13 list valuation, claim measures. Then the analyse of construction claim is based on the bargaining model of game theory and the bayesian theory, at the same time quantifies the discount factor, then claim game model considering the discount factor is established. Finally through the simulation calculation of the case which is divided into two phase, the contractor and the owner reach an agreement on price. In the negotiation preparation phase is the analysis of duration and cost of claims, the estimation of reservations; in the negotiation phase is the specific links.Thus the applicability of the established game model which considering the discount factor claim is concluded, providing guidance and help for the owner’s claim management.
